Long story short my fiancee works in the cruise industry and everything we were told indicated her C-1/D visa would allow her to stay 29 days after her contract ends this October 8th. I was planning to pick her up in Ft. Lauderdale and bring her back to my hometown to meet family & friends and see the area. As the date nears I started doing research on exactly what she needs to provide to get legal permission to stay here. A call to to the national US Customs & Border Patrol office gave me the details and everything seemed in order. Just to be safe I called the US C&BP office in Port Everglades (Ft. Lauderdale). As the topic says, I was given some bad news. I was told by one of the agents who do the actual checking of crew members that her C-1/D visa would be changed to a 'D2' and with it she would be required to depart on her scheduled flight back to the Philippines. The 29 day period is only to be used for a crew member getting to/from the ship and is not possible to be used as a 'vacation' in the US before or after the contract.

So I went from being very happy after talking to the Nat'l US C&BP yesterday because it seemed like there would be no issue with my fiancee staying with me for 4 weeks at home to very sad because I learned this isn't possible. Sigh... I'm not looking forward to giving my fiancee this news this afternoon... :(:cry: Sorry, just wanted to rant/vent a bit...

C1/D is a b!tch of a visa to do anything but work on. You can't spend any time doing anything other than getting to and from the ship (or aeroplane - they use them for airlines too) and you can't adjust status from them, so you can't do AOS whilst you're working on a ship.

From this C1/D holder, I feel your pain. I wanted to sign off the ship as a tourist, but because they screwed up my sign-off date I had worked since the last foreign port and they wouldn't allow me to. I wound up flying back to the UK, turning round at Gatwick and getting straight back on a plane to visit my (then) boyfriend.

Definitely sounds like you need a trip to the Philippines....

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.

Thanks for the sympathy everyone. I guess things could be worse so I'm going to try and look on the bright side. By that I mean I have the love of an amazing woman. It's just a little depressing right now because we were both looking forward to being together for 4 weeks here.

I changed my timeline. Not sure how that date got in there. We are planning to file in either October or November so maybe I put it in and forgot?

As far as me going to the Philippines, we were planning to go there together after her visit here. Since that can't happen I have two options. Either I pick her up in port in October and return to Manila with her and spend 2 weeks there or I go in November as planned and spend 3 weeks there. I do not have enough vacation time to stay 3 weeks in October. I'll be using the Thanksgiving holiday and borrowing 14 hours of time to stay 3 weeks in November as it is. I'm leaning toward the latter option because 3 weeks is longer than 2.

My fiancee called while I was writing this and while we're both disappointed we both agree it's just a minor bump in the road of this long visa journey (weak pun intended). She agrees with me on sticking to the original plan of 3 weeks in November as well. She did mention that she thinks her I-94 was good for 36 or 72 hours (she's unsure) so maybe it would be legal for us to spend a night together before she has to return? I'm going to call Ft. Lauderdale again and check it out. We both want to make sure we don't do anything to cause a problem with the visa petition. Either way, I'm still going down there to see her get off the ship and see her off at the airport. It will be 11-12 hours round trip but like I told her early in our relationship, I would make the drive just to see her for in person for 1 minute. (L):luv:

Yep, you're right. That's what I said in my previous reply only I said '1 minute' rather than 1 hour. Unfortunately, her contract had ended and she had already returned to Manila. That's why I visited her in June. :) Oh well, I'm still looking forward to seeing her in person again. It will not be 4 weeks like we planned but it will be the best afternoon I've had in 4 1/2 months! :)
