Looks like the package was received on Friday! At least it got there okay!

Canadianmade - don't worry about it, a little chit-chat along the way makes this board a lot less boring while we are waiting for arrivals, notices, appointments etc! There is most definitely a lot of bonding that goes on in these forums as you well know from when we were Oct. '08 filers! You, for one had a rough ride in this process and we were all there with you! Chat away - they'll just ban us if we're a problem!!! B-)

I have our packet ready to go to the post office, but our "window" hasn't opened yet . I'm not going to mail it until after Christmas or maybe even the first of the year. I just don't want it to get in the week before Christmas chaos at the postoffice.

I wonder if USCIS had a tidal wave of applications trying to beat the fee increase in late November that will slow things down for the December group. Along with employees taking vacation for the holidays, it could increase our wait more than those a few months back.

What I'm curious about (that the lists in these threads don't show) are who got RFE's? Are there many? And does anybody ever interview? I started looking at some earlier months wondering about interviews, but there's no data. I was also curious if people who don't have AOS interviews might expect one for ROC. I guess not. I have found in my research that cases can be approved immediately and cases are assigned a fraud level of A, B, or C in the beginning. And computers actually choose who interviews, with the higher fraud level having a higher chance for interview. But a pretty innocent case could get chosen by the computer, while a highly suspicious case might beat the odds and not be chosen by the computer. The percentages of each fraud level that the computer gives an interview is set by the director of the regional (or maybe local) offices. So one area might have a director who chooses to interview 0% of the level C's, but another locale might choose to interview 15%. But it's the computer that will spit out interviews equaling 15% of the level C applicants. How weird is that? So getting an interview could mean you're unlucky, rather than have a shady case.

Now that is VERY good info I was not aware of. Do you know what criteria they use to establish the fraud level?

Now that is VERY good info I was not aware of. Do you know what criteria they use to establish the fraud level?

Here's what it says. (And re-reading it I see that all Fraud level A's have an interview). And the service center can waive the interview process if the director feels the marriage was not for the purpose of evading immigration laws. --------

In cases where an interview is deemed useful for the adjudication of I-751 petitions, the Service Center Director shall forward the petition, along with the assigned fraud level, to the district director having jurisdiction over the place of the alien's residence.

(2) Assigning Fraud Levels . [section (g)(2) updated 06-20-2006]

If an interview is deemed necessary, the case is sent to the Service Center's Adjudications Unit and given to an adjudicator to assign a fraud level. The fraud levels of A, B, and C are assigned to the I-751 based on the documentation submitted with the application. If the adjudicator is fully satisfied that the case is approvable, then a fraud level of C is assigned. If the adjudicator is less than fully satisfied, but still feels that (based on the information available at the time) the case can be approved, then a fraud level of B is assigned. If the adjudicator has serious concerns about the approvability of the case and/or wants the applicant and the spouse to be interviewed, then the case would be assign ed a fraud level of A.

· Reasons for Assigning Fraud Level C. If you assign a fraud level C, it means that there are no technical problems (signatures, missing information, lack of evidence, etc.) and you think the case is approvable (no interview necessary). All required supporting documents are attached and there is no indication of fraud that can be identified in the documents or through the biographic data of the parties involved.

· Reasons for Assigning Fraud Level B. Fraud level B cases are those cases which have no technical problems that need correction and have the minimum number of proper supporting documents, but there is something, or an absence of something (which you may or may not be able to articulate) that creates suspicion about the bona fides of the marriage, the veracity of the evidence, etc. The reasons for suspicion are so varied that a concise list cannot be made. An example would be where the I-751 is supported by t he minimum required number of documents, however the documents are all of recent origin. Remember, though, that a level B case will be approved if the computer randomly does not assign the case to an interview slot, so do not assign a fraud level B if the application and /or supporting documents are insufficient to approve the case.

· Reasons for Assigning Fraud Level A. Fraud level A should be assigned when the adjudicator strongly suspects fraud. Reasons fraud level A might be assigned include:

- the petitioner fails to sign the form;

- there is insufficient evidence;

- a large age difference exists between the spouses;

- the married couple is not living together;

- a prior I-751 was denied;

- the petition was filed untimely without a good reason for being late; or

- any other reasons as the service center director may determine.

Note:

The service center adjudicator must indicate when fraud is suspected, rather than a technical omission, to alert the Fraud Detection and National Security (FDNS) Immigration Officer at the District Office.
