Hi all, this is my first post so be gentle with me :bonk:

The hubby (USC) and I will be filing for AOS for me hopefully in the next fortnight but I have a few questions, I hope that you knowledgeable folks might be able to help me.

This might seem straightforward to most people but I'm just so stressed out from reading these forums and the forms over and over again, that they're starting to confuse me!

When it comes to the section on the G-325A asking you to fill in your residence history for the past 5 years and then the next section is for the applicant's last residence outside the US of more than one year, this is where I'm having doubts about what to write.

My hubby has lived overseas for the past 5 years so should he just fill in the section asking for details of the address outside of the US for more than one year? Or do you think he should list them all for the past 5 years just to be on the safe side? We have only been in the US for 2 months and I feel like the 5 year section applies more to people who have lived in the US for the past 5 years.

Also, in my case should I also only fill in the section for the residence outside the US for more than one year, or again would you suggest filling in all 5 year's worth?

Apologies in advance if it seems like I'm asking something really obvious, I feel like my brain is fried :help:

Thanks in advance

They want to know the 5 years for both of you. Of course in your case this means the 1 year abroad section will just be repeating the info you give in the 5 year section, but that's ok.

What visa are you adjusting from? Who is the USC, who is the immigrant?

Re the G-325A, For your husband (who I assume is the USC), he needs to fill in ALL his addresses (no matter where) in the part with 5 lines available. If he has too many addresses then you would attach a separate sheet to list the others. In the section for last address outside USA of more than one year, he would write the last place he lived outside the USA (even if mentioned above).

For you it would be the same.

The form isn't tailored to anyone, it's tailored for everyone. For myself for instance, my form had many addresses in the 5 year section (plus an attachment for addresses), the USA section obviously had the last address of the place I lived for more than one year, outside the US.

Oh i just realised what I think you think the form means.. If I lived in once place, lets say Australia for 5 years that address would be in the address location (with the 5 slots) AND the outside USA qn. If I lived in Melbourne Australia for 2 years, then Sydney Australia for 2.5 years (it being my last address) I would write the Sydney address in the 1 year slot but both would be in the "all addresses" section.

Make sense?

Yep I got it! Thanks, you both gave me the answer that I already had suspected. I just wasn't sure if I was being a bit slow.

I'm currently on the VWP which I know causes lots of (mostly justified) tuts from the VJ community from what I've read. But our situation really is unique, we've both been living overseas (neither of our home countries) for the last couple of years and genuinely weren't planning on staying in the States. We just came here to visit his family as he hadn't been home for 4 years, but being back has made him realise that he wants to stay. So much for our nomadic lifestyle

I have a few weeks left before my I-94 expires and we're both fully aware of the potential repercussions.

Thanks again for your help.

It's a good thing that you are aware about the adjusting-from-VW-issue. Since time is not your friend, you will need to focus on getting the I-130 and, tied to it, Affidavit of Support approved.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Adjustment of Status from Work, Student, & Tourist Visas" as you are adjusting from the VWP and the prior forum is for K1, K2, K3 & K4 **
