Hello everybody!!!

I moved to USA last october 29th and my fiance and I are getting married December 17th. The thing is that today his job let him go (not fired but jobless) so he doesn't have a job now... He will get payed some for that though but what should we do in the AOS? Do we need a cosponsor? I am applying as well for the EAD within the AOS so if he didn't find a job by the time I could start working I would be able to find 1,2 or 3 jobs...

Someone that went through the same situation or can help us with some information?

Thank you in advance. God bless!

If he can not prove a steady income when you file the AOS you will indeed need a co-sponsor. It does not need to be family, it can be a friend. You will be applying for the EAD along with the AOS so I do not think you will be able to sponsor yourself, because you need to send all the paperwork together. And they want a "picture" of your financial situation at the time of filing, not what it might be 6 months later. So unfortunately they do not care about your intent to work.

The other option (instead of co-sponsor) would be if your husband can show enough assets: house, money in the bank... I do not know what the minimum requirement is, but I am sure someone here will be able to tell you.

Good luck.

In order to use assets, the amount you need for your household size (for example $18,212 for a 2 person household) must be multiplied by three.
