Hi, I'm new to this forum here and while browsing through I noticed that everyone has stated that for the I-864 you need to include your last three tax years...I already sent in my AOS packet on 11/10/10 but I only included the most present tax information as it said in the instructions that it is not necessary to include all three years or at least that is how I read in...I called the NVC up today and they told me it takes 20 days to review and tell me if I have any missing documents...and i didnt include an employment letter either just sent in copies of my last 6 months pay stubs...does anyone have any insight whether they are going to request additional documents so I can start preparing them...thanks

Only the most recent tax return is required (for the I-864, consulate requirements might be different) but you are required to have FILED the last 3 years with the IRS and write that information on the I-864.

The employment letter and pay stubs aren't required for the I-864, but they might be required for your particular consulate. The only reason to include them is if your latest tax return isn't above the 125% for your household size.

For example, my husband was over the $18,212 required for a 2 person household for 2009 (when we filed). We ONLY sent the last 3 tax returns (sent them all because I could) and no employment letter or pay-stubs. We were approved without interview or RFE (this was for Adjustment of Status).

You should be fine at this stage, if you have filled I-864 properly.

It is recommended to provide current year income details, if the last year income is very close to the poverty line.

Gather all other documents at the interview time, just in case.

hmm if that is the case then I guess I messed that part up cuz I only put the info for the most recent tax year on the I-864 not the 2 and 3rd year since i thought it wasn't necessary...i thought for the poverty line they looked at the most recent tax year and the current individual annual income...I guess I'm gonna find out sooner or later if I did this right :/

ughh don't know if I filled this properly, I wish I had just listen to my dad when he told me to add the extra info as extra stuff can never hurt...

hmm thankssss I def will need to do that cuz I don't want them to say something is missing at the time of the interview that, would be horrible..

mentioning the info proves you file, you don't need to include the returns but it was my understanding you at least had to list the amounts there.
