Hi everyone! I 'd like to bring my sweetheart from Ukraine to over here some time next year and have a question. Will a possible denial of a visitor's visa affect the decision for K-1 when I apply later? She wants to travel to US to some distant relatives of hers to participate in a baptism ceremony of their child and other things related to that. They will be sending the invitation and doing the rest of paperwork for that trip. Is it still the grounds for denial if my name is not there? Being eventually with me far outweighs in importance the trip to the relatives so is it worth the risk, if there is any? Thanks in advance!

Denial of a tourist visa does not have any weight in the fiance visa decision. Best of luck.

A denial will not have an effect on your K-1, however she will have to answer honestly if asked if she was ever denied a visa.

I'm going out on a limb and assume the criteria for approving a tourist visa from the Ukraine is similar to that of China.

The reason for such a denial is usually based on having adequate resources in the home country to make compliance (returning home before the duration of stay expires) probable. In China, it usually takes the equivalent of $30,000 in the bank, being a home-owner and/or owning other real assets also helps.

So, if such a visa were denied, the criteria for the denial would probably have no bearing on a fiance visa. However, if the tourist visa was denied for relevant reasons (criminal record, previous visa fraud, etc.) each visa application would decrease in probability of approval.

I would suggest waiting for a period of time before applying for the K1 if the tourist visa is denied for any reason. Immediately applying for a different type of visa could raise 'red flags'.

You are correct except the last part. And that the qualifications may vary in detail. But a tourist visa denial will have NO AFFECT on a K-1 provided the denial is for the usual reasons and not because she is a an international terrorist or something. File away.

In SOME high fraud countries (Ukraine is not one) multiple filings for tourist visas, student visas, business visas, etc., followed by a K-1 could be seen as a "red flag". The application and denial of one tourist vosa follwoed by a K-1 will nt be a problem.

As already mentioned, NEVER LIE on any application or in any interview. If they ask a question in an interview, ASSUME they already KNOW the answer.

She can. But make sure as of this moment if she is your fiancee then she would have to answer the question that "yes, she has a finace in US who is an american citizen". Getting denied on a tourist visa is no problem but later on if they find out that she lied on a her previous application, then it is a total different ball game which includes immigration fraud and it is a big issue.

My fiance got denied a tourist visa once, he was truthful in all his answers. On his K-1 petition we were also truthful and mention this denial. It had no impact in our process not even a question during the interview about it. :thumbs:

Denial of a tourist visa will have no affect on a K-1 visa unless they denied you based on A: finding that you lied on a previous application (visa fraud) B: denied you because you were inadmissible based on other items which also make you inadmissible for a K-1 (ex. overstaying a visa)

You have the right idea with having the invitations etc. for the baptismal. Keep them. Especially if she is denied the B1/B2 visa, she may need to show them that she had no intention of using her tourist visa (which she was denied for) as a means of entry to marry you.

I kept the receipt of the booking for a cruise which was why my fiancee was attempting to get a tourist visa for prior to our K-1 filing, and plan to have it ready to show if they ask for proof of not trying to enter for marriage and only for a vacation.
