We really don't want to wait anymore to get married. I will be visiting her in October in the Philippines and would love to marry her.

What implications are there to the K1 Visa process if we are married while still waiting for her Visa? Do we have to be married in the US to fulfill the 90 day requirement?

You'd would make the K1 worthless. You'd have to file for a K3 I guess. So you'd go back on waiting again.

Mew is right. If you marry prior to the K-1 issuance, you are starting from square one with a K-3 petition.

There are other options for this scenario, but I am not versed on those. Others will offer that piece.

You can have a wedding that is not legaling binding and that would allow you to continue a K-1 but if you legally marry her you must start over and do a K-3 -- some say it takes even longer to do a K-3 -- so find out what makes a wedding legal and bvinding and what makes it just a nice ceramony and do that only.

we're planning on the same one with our case. we're going to get married on october but not legally. its more on blessing.

Be carefull when you do that. If the CO gets wind of it he may deny you just out of suspition. At the very least you would buy yourself an AR while they check it out. They don't need to prove your married, you need to prove your not. Remember that.

Trust me, I want to marry Luz in the worst sort of way. We have talked about it many times. But we both realize that to do so would only add to the waiting time. Just be patient. I know that is easier said than done but it's really the only choice we have.

Gary is right. Careful with that approach.

I did the ceremonial thing in Indonesia, with the intention of DCF. Could not produce the documentation for it. Local officials did not understand how to produce the docs with a "foreigner" involved.

Visited the Consular section in Embassy Jakarta, was advised that without documentation, K-1 was our only option.

In Indonesia, that shortcoming is understood. Elsewhere in the world, it may create a major problem for you. Be very careful.

Also, as I once learned on VJ, in some countries, unlike in the US, a cultural/religious wedding IS a legally binding service even without official government documentation. I don't know if the Phillippines has such laws, but it's another reason to be careful about what you do in this regard since you could be legally marrying but not even know it.

Try to just let the USCIS wheels crank along on your case without interruption, since any interruption will just confuse them and set you back weeks, if not months. Use your next trip as further evidence of your relationship with your fiancee for her interview -- take lots of pictures together and save all of your travel documents. It will make your case stronger and the consular officer will be more inclined to approve your case and issue the visa :thumbs: Believe me, there is an end in sight!

I completely understand your wanting to get married as well. Don't do it!

While on my brief visit with J, believe me, thoughts of just abandoning my life here and staying with her there crossed my mind. I wanted to marry her a long time ago... I have no idea how much longer we will be apart, but I came home, filed, and am in line with the rest of you couples.

Hang in there, you are lucky you will be going to visit her. Have fun, do the documentation thing to bolster your case, and who knows? Perhaps you will come home to an approval and she won't be far behind you with her K-1 visa in hand!
