Hey guys just wanted to make sure ..I am the petitioner but this is my first year of working and dont make enough to meet the requirements. But my brother who lives separately will be sponsoring my wife. What I wanted to ask is that do I need to send any documentation from my part and is just the I864 from my brother will be enough?

wat do u mean by tax documents. This is my first year of working and have not filed taxes yet. I can submit my paystubs and my employment letter if that is needed. I will have the rest of the documents from my brother

In fact, I think your brother will be your sponsor since you can't provide the tax return.

I guess if the interview was in JAN, Feb, or MARCH you could say i have not filed my income tax yet, for 2010.

That's correct, you file for tax return2010 in April of following year :thumbs:

Unless they are getting ready to file the I-130 now, they will have time 5-6 months...!?

You would want to do whatever is best for the case. The deadline for filing a tax return is April 15th. They can be filed at any time.

If having the tax return makes things stronger then go ahead and do it. The focus should be on a successful interview and obtaining a visa.

Thanks for the responses guys. I filed my petition in july of this year..and right now my case is at NVC with AOS fee paid. Now waiting for IV bill generation. I am hoping for interview in November or December. And yes I have not filed my taxes yet so will be using my brother's financial info as joint sponsor.

When you mention first year of working does that mean you haven't filed income tax before? IF you haven't it's best to still fill out a tax transcript request form to receive a proof of non-filing as it does mention further proof from IRS in the I-864 directions and a letter written by you explaining why you didn't file.

It's best to be thorough in my opinion.

Also if you started work this year and it hasn't been a full tax year send 6 months of paystubs or paystubs since the start of your job as proof of your income.

NVC or Consulate no way knowing why you didn't file taxes in the prior years. Instead of them do guess work, I suggest you to explain it in the letter. Better play safe game!

I agree! :thumbs: A tax transcript would be better & safer for you. They can clearly see that you didn't file tax return with the aos, what they don't know is "why" maybe you should explain,it would show that you have nothing to hide!Try avoid a potential (hate to say it out loud...) rfe :( Since you have a valid sponsor you should be ok :thumbs:
