i864 and i864a

ok so my wife and her father are filing out the sponsor and co sponsor forms.

i dont have them in front of me so please bear with me while i try to ask this question on her behalf.

as she is on disability nd makes way below the poverty line - she doesnt file taxes, so a letter from herself explaining why so is needed to accompany her i864.

at her parents house is my wifes father, mother and my wife. that will also be my residence when i return. when filling out the forms - do they both put a household size of 3 - wife,mom,dad. or do they include me as a fourth? im thinking just 3 right?

also my wife said does her father include his wife on the 864a or is it just about himself?

IM confused to as the household size works for the I 864 Loto. I may have misread the instructions... I thought your household size depended on who claimed who as a dependent. Allow me to explain. The father is filling out a I0864A because they share an address together. However when the wife is filing the I864, she could just put her Household size as her and the immigrant.. But will still list the father in the household list on the following page when declaring their income... Sounds right or Did i miss a crucial line in the packet yet again? :)

Yep. On the I-864, you add in in part g on the household size portion anyone who is filling out an I-864A and adding their income to yours. It's nothing to do with dependents claimed on taxes.

But i think after combining the income of petitioner and the household member(dad) is above poverty guideline then dont need I-864A from her mom. Let see what other say??If i am wrong then correct me plz.

That's correct :thumbs:

Petitioner's and the household member's(dad) combined income is above poverty guideline, any other household member's income is NOT needed.

Show dad's personal income if they have married filing jointly. If dad has filed taxes separately, it is even easier.

We are using her father in the same household as a joint sponsor so I know that he must complete the I-864A form. I am unsure if he needs to include W2's and 1099's along with the IRS transcripts?. Does he still need to include these even if the transcripts are originals? How many years should he include?

There's what seems like conflicting info on the I-864 and I-864A instructions.

If your FIL filed the taxes separately, last 3 years tax transcripts plus his current year income proof (employment letter, paystubs etc.) is good. Otherwise, I would suggest to include FIL's W2/1099 with his tax returns 1040 and its schedules for the last 3 years plus current year income proof.

If your FIL filed the taxes separately, last 3 years tax transcripts plus his current year income proof (employment letter, paystubs etc.) is good. Otherwise, I would suggest to include FIL's W2/1099 with his tax returns 1040 and its schedules for the last 3 years plus current year income proof.

I would suggest to write an explanation why she didn't file the taxes in prior years as well. It might help.
