I would suggest to write an explanation why she didn't file the taxes in prior years as well. It might help.

But i think after combining the income of petitioner and the household member(dad) is above poverty guideline then dont need I-864A from her mom. Let see what other say??If i am wrong then correct me plz.

Pushbrk is passing along the right cautionary advice. Why not be prepared and avoid the RFE?

Over the past year (or so) there have been directives sent out to the field (embassies, consulates) regarding 864A's from the spouse of married joint sponsors. This is resulting from the economic problems and wanting the non-sponsoring spouse to be aware of the joint sponsor's commitment. By having the spouse of the joint sponsor submit the 864A it demonstrates their knowledge of the commitment.

A few VJ members have also mentioned this being required of their joint sponsors. I can't point you to the cite right now. The info is here on VJ.

Whether an I-864a asks for household size to be totaled or not, the fact that Dad is married will have an impact. I would advise an I-864a from each parent.

This is interesting.. But what if the household members who are married live in different addresses? Would this require another I-864 from the spouse even though they are not the joint sponsoring party?

This would get murky especially if the other spouse was not interested in sponsoring the intending immigrant.

Anh map,

I am really confused here. By reading this note and the Post# 13 in the link (http://www.visajourney.com/forums/topic/280795-i-864a-current-income-question/ ), it seems contradictory, IMO.

It could be. But that wasn't my intention.

In this thread I was responding to the question of why it was suggested that the nonsponsoring spouse would need to file an 864A. There has been evidence here that supports Pushbrk's recommendation.

In the other thread the OP was working through having a joint sponsor who is a business owner and I suggested that a joint sponsor with just wage income (in that case the proposed joint sponsor's spouse) could be a cleaner solution. There could very well be a request for the nonsponsoring spouse to submit an 864A as well.

So I can conclude like this. If I miss anything, please let me know.

Even if the petitioner wants to show one of the joint sponsors' I-864A (because this one joint sponsor/household member makes enough income), it is recommended to include both the joint sponsors' I-864A (husband and wife joint sponsors in this case) so that each joint sponsor is aware of the other joint sponsor's contractual obligation.

The list is good.

You don't have to prove the relationship. It can be anybody based on the above criteria I mentioned.

You will file I-864 and your cousin will file another I-864. Send both packages together in the AOS package.

Richi's wife will file I-864 and her father will file I-864A. Now the household size in I-864 is as follow and there is no household size in I-864A.

Item #21 a - Richi(beneficiary) ------------------> 01

Item #21 b - Richi's wife(petitioner) ------------> 01

Item #21 g - Petitioner's Dad(household member) --> 01

=======================================================

Total Household Size = 03

What if her father claim somebody beside beneficiary on his Tax return then what would be the Total Household size 03 or add number of claim person....... Little confuse on this part :bonk:

Here her father is household sponsor not a co-sponsor.So even if her father claim somebody as a dependent on his Tax return,hes/she will not be counted. There is no colum in I-864 for adding the dependent of the Household Sponsor. But suppose if her father lives at other address and he is going to file I-864 as a co-sponsor then he will list his dependent children in Item#21 d & other dependents in Item#21 e. So here the household size will not be affected.Here her father is sharing his only personal income.
