it depends on what is her priority date. did you file for her recently? then yes if she is unmarried. a person can have more than one petition filed for them. she can file for her. probably in less than 2 years if she is under 21 if your mom files for her.

Thank you for your reply. her age is 16 and i think i will be a better off if she just files her for visa avaiblitity. I applied the form in March 2009.The case is at NVC it already approved from NCIS. Not sure

I agree, the wait for your sister is over 7 years more on your petition. so definitly your mom should file for her.

You can have more than one petition for your sister in the system. Your mother will be a quicker route but having a second petition is good in the sense that should something happen to your mother your sister will be able to continue her process through your petition.

This will not be over quickly. You will not enjoy this.

Both My parents are here. Should they apply both or one of them. What the difference would it makes? my Concern is if one of them not availble down the future one would carry on.

so your father is also a LPR? there is no difference. that's a decision your going to have to make as a family. anyway, your petition is still there.

hopefully your parents will be healthy for many years to come. it isn't that long anyway for unmarried children under 21.

I agree with the other posters. You sister will get to the US much quicker if your parents petition for her.

I can also understand being worried about your parents health and effects it may have on your sisters petition. NigeriaorBust said that you can have more than one petition pending for a person. You should definitely consider this...if you apply for her at the same time as your parents and something happens to them during the process it will only delay your sister by a few years, better than starting at the beginning.

Also as soon as your sister finishes high school she is eligible for the DV lottery. She should definitely apply. Of course the chance of winning is small, but it is quick if you are chosen.
