USCIS incompetance!

This is sheer incompetance on their part, I am really sorry! Also, I fail to understand the significance of applying early for AOS. I mean I am really happy for all my fellow VJ'ers who have been approved but why are the people who have applied in May-June put on the backseat?

USCIS does have a method for complaints when they make blatant error that costs you financially.

I know that in the UK they only keep a copy at the docs office and not the original, because the doctor told me that. USCIS may not accept a copy and only the original? Senator's office sounds like a better bet if it comes to it.

That may be the case normally, but if they have already admitted the mistake, it doesn't hurt to ask if they will accept a copy and then the doctor can forward a copy to you. Less time, hassle and expense.

I'm sure that other UK-ers would be interested in what the magic words are to get Knightsbridge to release a copy of the medical to the beneficiary are. In the past people have been refused. I guess maybe if they mail them directly to USCIS...:-/

Ok, update after spending another 3 hours on the phone and receiving none of the promised call backs:

I spoke to an officer who said that what I should do is submit another copy of the I-693 vaccination supplement that I got signed in the states along with a letter explaining where I had my previous medical so that USCIS can try and get another copy.

I have to say I am a bit nervous about submitting a letter in place of the actual evidence they requested, but I got the officers name who told me to do it, so I guess I have good grounds to appeal if they kick up a fuss about it.

Any thoughts?

Coming from the U.K., it's perfectly understandable that you're having a hard time coping with the screaming incompetence in the US. It was, and still is, the hardest thing for me to adjust to. The US is a country full of incompetent people. Be advised that those with complete brain removal work either at the SSA or the DMV.

Well I rang again to get a second opinion, as I had now had several different versions of what to do.

the guy i got on the phone refused to help me saying "You have been told what to do" and then hung up the phone ignoring me saying I had been told different things.

I am currently fuming and looking to get a lawyer involved now.

And the final update for anyone following this.

I heard back from a supervisor that what I have to do is do the medical, then send a letter requesting reimbursement. If they dont do it, then i have to take it up with Ombudsman.

first rule of RFE - comply, or risk denial.

For the sake of my family, I think the $200 is worth risking.

Seriously. CALL YOUR CONGRESSPERSON or SENATOR. You simply do not have access to the appropriate resources to get it sorted out on your own!

The only reason I havn't gone down this route, is because I was given a month to respond to the RFE. Ultimately it comes down to the fact that I will comply with the request, redo the medical (which I had done today), and kick up a ###### storm afterwards.
