Oh.. I am confused now when it comes to the name change issues.

I am married and i used my husband family name to all my application for AOS.

and assuming my single name: First name / Given Name - Mari Clare ( written as two name)

Middle Name - Legazpi ( for Philippine this is my mom family name when she's still single and we carry this as our middle name)

Family Name/ Sur Name - Madrigal - this is my father's family name and we carry this as our family name..

Now, I am married : so my whole name would be like this: Mari Clare Madrigal Smith - we always have the middle Name / maiden Name through our family name name when I am still single...Is this be a problem and I used all this in my forms for AOS and in my marriage License Certificate also follows like this: Mari Clare Madrigal Smith?

Also, I went to SSN office to apply my SSN card, Unfortunately, I wasn't able to have my SSN number and were being told that even though my I-94 still not expired ( Nov 18, 2010 expiration) they cannot process at thsi time since we already married and he told us that I am no longer a K-1 Visa and the 90 days is no longer applicable for me to have the SSN and he told us if I apply for SSN before I got married they can process my application so I need to wait for the EAD or GC to have my SSN as they told me.:-( .Anyone can enligthen this matter? are the SSN officer is correct? How come some Vj's got their SSN number eventhough they are already married?

Any inputs are highly appreciated.

How come some Vj's got their SSN number eventhough they are already married?

Your name is fine but the SSN is #######. You can get your SSN before you file AOS I did and was only married 3 weeks.I did not need EAD or GC Got it in my married name as well. Go back and get someone else who knows what they are doing in the office.

I am in Georgia and had no problem unless other states have different rules which is possible in this country.

I am not an expert on the SSN office, but from my review of the procedures, they do sound correct. There are many posts and guides here on VJ about the recommended time line when to apply and get a SSN card. I can attest to the correctness of the guides because I followed them to the letter with no issues.

The ideal time for you to apply for a SSN was approx. 2 weeks after you arrived as a K1, in your maiden name and unmarried. Then you marry within 90 days after POE and go back to the SSN office(after the honeymoon!) and simply do a name change on your card.

Sorry this is not what you wanted or needed to hear.

My wife got her SSN after we were married in her maiden name, then changed it once we got our marriage cert. Try a different office or hope you get someone else at the same office. She got turned away initially when she tried to do the name change but the second time she got someone with a clue.

The SSA are perfectly correct. If your I-94 is expired you CANNOT apply for a SSN. If you already HAVE one you can attend the SSA to change your name to your married name even after the I-94 is expired.

HOWEVER, your best bet if you already have a SSN, is to wait until you have your EAD or GC to change your name.

As your I-94 is expired you cannot apply for a SSN and will need to wait till you get your EAD or GC.

A SSN is not required to file AOS so don't worry about that.

As your marriage certificate says your entire name "Mari Clare Madrigal Smith" then you will be fine putting that on all your forms etc.

We accept all marriage documents issued within the 50 United States, Washington, D.C., Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa.

RM 10212.025 Evidence of Name Change based on a US Ceremonial Marriage:

We can accept a name change document based on marriage as evidence of the new name to be shown on the card, if the new name can be derived from the marriage document.

Any of the following changes to the last name, using the names shown on the evidence, are permitted:

-- groom takes bride’s last name;

-- spouse or partner takes the other parties’ last name;

-- spouse or partner takes one part of the other parties’ compound

surname;

-- compound name (with or without hyphen) of each spouse’s or partner’s

original surname for either or both parties

Example:

Lisa Foster submits evidence of the name change event, her US ceremonial marriage to Bryan Lee-Walsh. She wants to change her surname to a compound surname, Foster Lee, with only part of Bryan’s surname. At which SSA office did the knuckleheads tell you this? SSA policy is that you have K-1 status and it is not expired or within 14 days of expiring. Being married does not affect things as far as getting an SSN is concerned.

If your I-94 expires November 18th, you still have plenty time left.

Thanks for the replied... Oh well iwas really surprised that he didnt accepted my application since I know I have an ample time to apply and my I-94 still a long way to be expired. At first I tried to explained that I am eligible to get my SSN eventhough we are now married and I even print out that K-1 Visa is allowed to have an SSN. The officer vividly stated that I am no longer a K-1 Visa since we already got married..so I zipped my mouth and I never argued anymore..and I also heard in other window same case with me and they argued but still they insisted the same what they told us..and until then I guess a supervisor came to the rescued but it looks like they end up frustrated like we do.

We went to SSA Office Minneapolis branch...

Too sad that they refused us and I really needs an SSN to start working some important matters that needed an SSN and it looks like I am totally stuck until my EAD is approved.

And I guess the officer never question my name change to carry on my husband family name as I already provided them a copy of our marriage certificate..what he really told us is my K-1 Visa is no longer valid since we already got married..and he emphasized as well if I apply an SSN Card before I got married with valid I-94 they will accept my application..so he said wait on your EAD in order for me to get my SSN..

Is anyone around or nearby Minneapolis /Minnesota luckily got an SSN Card same case with me?

My I-94 still valid until Nov. 20, 2010 so it still a long way to be expired and have an ample time to get the SSN..but the officer quoted that I can no longer used the K-1 Visa no matter if I still have a valid 1-94 since I already got married..If I apply before I got married then they will process my application..

So now it looks like I am totally stucked and wait for a few months before I have my EAD or GC..and I felt I cant do anything but too wait until I got approved with EAD or GC..and I cant start as well to work things out with other matters that needed an SSN number..So frustrating since others are lucky to have an SSn without hindrances..

You're more than welcome but yeah go to another office and try. As I said I had no trouble at all just showed my marriage certificate, and took my passport with visa in it and they were fine. I had it within the week.

Yes, we went at that office in Chicago area, but they refused our application...so I am trying my luck if other branches like St. Paul, Edina, Brooklyn they will accept my application..

You mean, only in chicago area is allowed to accept my application if I lived not really in Minneapolis, but in nearby cities..
