Hi,

I read some posts regarding expediting the I130 application. Some had suggested to contact the congressman/senator and some had mentioned about their excruciating circumstances USCIS to speed things up. I would like to find out about some of the ways to expedite the process. For example, do I need to have an excruciating circumstance to contact the congressman/senator? If I do not, can I still contact them and what should I say?

You may request for an expedite at the USCIS personally (the petitioner) when you feel like it. But be prepared to be denied if you don't have a very good reason for it. The reasons for an expedite are those:

Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

* Severe financial loss to company or individual

* Extreme emergent situation

* Humanitarian situation

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

* Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error

* Compelling interest of USCIS

If you have already filed your application or petition:

You can make an expedite request by contacting the National Customer Service Center (NCSC) at 1-800-375-5283 begin_of_the_skype_highlighting 1-800-375-5283 end_of_the_skype_highlighting begin_of_the_skype_highlighting 1-800-375-5283 end_of_the_skype_highlighting begin_of_the_skype_highlighting 1-800-375-5283 end_of_the_skype_highlighting. The NCSC will take a “service request” and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.

Congressman/Senator is no help unless you are past the normal processing times. You can expedite direct with USCIS but be prepared to supply documents from a Doctor and yourself supporting your claim if it's a medical emergency. If you want to expedite for any other reason you will need compeling evidence of such an issue.

I understood one of the reasons for an expedite was if the process was beyond normal time lines, such as more than 5 months for a IR1/CR1. November 2 will be 5 months for me. That is about 3 more weeks. Should I ask for an expedite on November 2?

I had to wait over 5 months for my NOA2 160 days...you will get your soon kicking.gif

under normal cicumstances, it does take more than 5 months for USCIS to finish review of your documents to be forwarded to the NVC. mine took 6 months. so you coming up on 5 months is normal.
