yes if you didn't include her she is not able to join you if you win and you yourself could be found guilty of misrepresentation for not including her. She will never be able to join you .

Dear, first of all thank you very much for your important comment, but i have no intention to reject her if i will win. But the main problem is, she is now study here and has some other things including with. And she also know that i am not include her name in the form. Without that problem that you describe, is there anything else? Thank you

You are in a situation where you didn't include her so she can't come if you win. If you try to bring her later based on your marriage you lied on your entry and may get your status revoked for misrepresentation.

This will not be over quickly. You will not enjoy this.

Yes you are right but things will be not like that......if i will win (If Allah write on my Rijik) then i will not bring him based on marriage. I know that if i do so then they will revoked. I just want to know is there any problem before getting the DV visa?

Put his name on the form, in the meantime get a divorce and IF you're selected come to the interview with the divorce decree - that way he won't come with you. This seems to be what you want.

I am not that much sure that your way is right or wrong. Can you please let me know that without divorce, is there any way to skip her name in the form and create no problem to get the visa? Thank You for your important comment.

If you are married, you MUST declare this, and fill in your wife's name in the relevant forms. If you do not write her name on the forms, thatis missrepresentation and you could be banned from ever entering the USA, or deported if found out later. Putting your wife's name on the forms doesn't mean she has to come with you, just that she can if she wants to. If she chooses not to get a visa, or gets the visa and doesn't travel to the USA in the prescribed time (usually 6 months from interview/ issuance of visa)

They will be check all sorts of records on you. If you are in a high fraud country they will do more checks. They also will check whatever education you claim to have that qualifies you under the occupational requirement of this visa. I have seen plenty of people crying outside of the Lagos consulate because they lied and the visa ( and any future visa) is denied for misrepresentation.

If you are legally married, then there is a record. Even should they not find out now, they could find out, say, 30 years in the future and take away your US citizenship and deport you because you got the visa which lead to the citizenship by missrepresentation.

You of course do not need to answer this, but can I ask why you are so intent on not putting her name on any forms? You do realise it won't affect your chances of getting the visa, right? It's a lottery, you have the same chance no matter what. If she chooses not to come now, this is not a problem (my earlier post cut off for some reason!). Once you have your greencard, you can petition a spousal visa for her and she can come later. But you MUST put her ion the form now, otherwise you could be in trouble, no matter what she does.

Thank you. Its a good suggestion for me. ok, the main reason to not putting her name in the form because, in our day of marriage, there was no parents involvement. We married and two of our friends with us for other formalities was there. And at now we do not want to flash it to our parents, because i am not established that enough to stay together. So now she is in her own home. That mean parents are not know about that matter. I think you understand. Now give the proper suggestion please..........
