Is it possible that the $10K can be put into a CD or some other form and then used as an asset? This might eliminate the need for 12 months bank statements.

I think CD and bank checking a/c assets are treated same.

But OP may be in a good position due to relatively good income this year.

I had a similar situation. My current job is above poverty line, but I only got it last year. We used my husband's (benificiary) savings to make up the difference from last year's tax return and only submitted a single monthly statement from the bank showing said assets. No questions about it. Good luck.

One more thought (sorry can't edit anymore). You can choose to submit EITHER last 3 years or just last year by itself. 3 years is not required. It is in the instructions. Good luck.

If the current years income is above the level needed, you would need to prove that (letter from employer, similar to the 134 format, paystubs (6 months to be comfortable)) - and the most recent years tax return info.

They will take that in account (new job, making it now).

Add more years, even if they are below the level needed, to show you have a history of income.

No need to go through the rigor of converting assets - as you do not need them (since your current income meets the level at the time of the 864 filing). You could show bank statements with the level of money in savings (letter from the bank should suffice)

(b) If the Affidavit of Support or tax return reflects income below the poverty guidelines for the year the Form I-864 was submitted, you should request additional evidence of current employment or self-employment, such as: recent pay statements, a letter from the employer on business letterhead - showing dates

of employment, wages paid, and type of work performed - or other financial data.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

:thumbs::thumbs::thumbs: Thanks Bobby. I have been scratching my head about this all day. I was under the assumption that as long as the income met the requirement for the current year, no assets would be required...
