Hi everyone, I have a friend who is about to get married to a Nigerian in the USA. But she thinks that when he got married in Nigeria 15 years ago, she thinks that he never got a divorce, and they are about to get married next week. Do anyone know if immingration will find out if he is still married in Nigeria or do he have to get a divorce before they get married here in the USA. Please I hope someone can help her. Thanks

What do you think? If he is married already and not divorced how in heavens name did USCIS approve petition because they would have asked for previous divorce decree.

If he is still married then it is bigomy and that is illegal in USA and the world as far as I know. So she needs to find out quick smart and delay this marriage

Timeline

When he applied for his visa to come to the US he had to state his marital status. Whatever status he has in on record. IF that status was married and he marries without being divorced he will be found guilty of polygamy and that can cause him to be banned from the US. He must produce proper divorce papers if he ever listed married as a status on ANY visa request. ( previously denied visitors visas also count)

This will not be over quickly. You will not enjoy this.

Maybe he was married traditionally? Did he apply at a registry.If he did then legally hes married. Who knows.

Thanks everyone fro your comments. But I'm not sure if he put married on his application. I will find out when I get back to work on Friday. He's has been living here in the USA for 5 years, he has 2 kids, and his wife is living here as well. The only think I told her is to be careful.

His WIFE is living here too and yr friend is planning to marry him? how is that possible? if he put married on paperwork even if it was customary marriage he will have to find a way to produce divorce papers. if his wife is here in the usa too then at some point they must have lived together and there are records somewhere that will prove that. better to find a away to produce divorce decree before they get and trouble for bigomy and get thrown out.

getting married to more than one wife is not a crime in several parts of the world including Nigeria, so stick to what u know and dont write stuff u dont know!

Timeline

Find out his filing status on all previous petitions. ( both his current visa and any prior applications even if they were denied. ) If ANY of them either used MARRIED if it up to him to prove he has been properly divorced. If he ever said he was married on forms attempting to come here and doesn't prove he is divorced then any petition will be denied. You can easily marry a second person without divorcing The second marriage isn't valid but it may take decades to find that out.

This will not be over quickly. You will not enjoy this.

My dear friend, it's hard to properly asses this situation with the information you've presented. Did she bring this man to the U.S. ? Is she afraid to ask him about his wife/ex-wife that's already here in the U.S. Evidently she's already uncomfortable with becoming his wife; I don't understand why she would go thru with a marriage when she already has BIG question marks concerning him.

I heard from many Nigerians that it's easy to get any papers you want in Nigeria as long as you have the money to pay. Any Nigerian that marries a American citizen can get to America much sooner then waiting for their spouse's visa request. On the other hand if he already has been here for some time she should/needs to know if he's legally here in the U.S.

Many aliens come here on a school or work visa and overstay; when that happens the only way they can become legal is to marry and have their new spouse file papers in their behalf. The person must be an American ; Americans can get Aliens papers much quicker then a permanent resident . How well does she know this man?

June 7th, 05 gave birth to a boy child.

July 5th, 05 Victor packs he suitcase and leaves for good.

July 2005 2nd AOS appointment

( went and requested a reschedule )

August 2005- I file for divorce. and withdraw immigration paperwork.
