Hello everybody!!!

I have a question regarding study in the US... I will be moving under a K1 visa (to Dayton,Ohio) and to say dates, I will get married on november, apply for AOS on november too. The admission deadline of the university i would like to go is on march and the start of the semester on august.

The in-state tuition and the out-state tuition in this university are the same amount of money.

I thought that wasn't any problem in study while waiting for the GC...Is there a problem? Should I tell to immigration that i'm going to start college in case i haven't received yet the GC? Should i tell immigration that i applied for admission (once i do that)?

Whether there's any problem attending the university depends on the university. Many universities require proof of legal status to enroll. In some states, this rule is applied to all public universities by state law, but may not affect private universities. They may or may not accept an I-797C receipt notice for the AOS application as proof of legal presence. You'll have to check with the admissions office of the university to see if they'll enroll you before you get a green card.

I don't recall any questions on any of the AOS forms regarding school enrollment. The IO did ask my wife and both of her kids if they were attending school at the AOS interview. At that point, they'd only had one semester of ESL classes at the city's adult school. If they ask, be honest.

Because the university system is not really knowledgeable about the immigration status of everyone, it is very likely they will get it messed up or try to deny you by mistake. Make sure you make copies of your passport, I-94 from arrival and any applications for AOS for use by the university. If the tuition is the same for instate and out of state students, that's great. I would make sure on that point though. In our area, out of state students pay about three times more tuition than in state residents.

Thank you everybody for your replies!!! Well, it's a relief that attend college can't mean trouble with immigration...like that i can start as soon as possible...the sooner i start studying the sooner i will end up with it and will be able to get a good job.
