OPT to EAD

I did a search but couldn't find a question/answer close to my situation and am hoping someone who has gone through this or knows something about it might lend a helping hand.

I am currently on OPT (and working), but my OPT expires in early January. I'll be filing for AOS (family-based) soon and was wondering about the timing for applying for an EAD. Should I file the I-765 concurrently or wait a month or so - until it's closer to when my OPT expires. I don't know if USCIS will issue one person two EADs that overlap, if they will wait until my current one expires or if they will deny it because I currently have one.

I don't want to risk having to quit my job once my OPT expires. Anybody have any suggestions?

AOS timeline:

Mailed AOS packet on Sept. 9 2010

Day 2 - USPS tracking confirms delivery.

Day 6 - Return receipt from Chicago Lockbox received.

Day 8 - Text/email alerts received.

Day 9 - Checks cashed.

Day 11 - NOA1 received (all forms).

Day 16 - Biometrics appointment notice received.

Day 40 - Biometrics completed.

Day 53 - Initial interview appointment notice received.

Day 59 - EAD card production notice email/text received.

Day 70 - AP document received.

Day 72 - EAD card received.

Day 85 - Interview. Verbal approval received.

Day 88 - AOS approval notice received.

Day 100 - PERMANENT RESIDENT CARD RECEIVED! No USCIS until 2010!

My EAD was approved in 2 months and my AOS in 3 months I don't know about the overlap EADs but when you apply for EAD under a AOS your category of authorization is different (c09) so maybe it first matter if you already have one .

i have the same situation as well. My OPT's EAD will be expired in July 2011 but I am filing AOS and adjust my status from F1 to PR, I am not sure if I should file ©(9) EAD with my AOS package or I should file EAD later. I know USCIS will not re-new your EAD if you file 4 month before the expiration date, but since I will file under different category, I dont think the rule applies on me.

04/27/2010 - Applied for OPT, Form I-765 sent

04/29/2010 - Form I-765 received by NSC

06/01/2010 - Name correction confirmation received

06/03/2010 - Requested NSC expedite my case, rejected on 6/12

06/15/2010 - Called USCIS CS and asked for expedite. Faxed a expedite as well (again.)

06/16/2010 - Received an e-mail for more doc based on the call I made on Jun 15.

Your EAD will be taken from you once your GC is approved because you don't need it once you have a GC. Personally I would file for the EAD with AOS. Better to be safe than sorry.
