Hi everybody!

we received our travel documents 2 weeks ago, Katerina got plane tickets and went to Ukraine. well....the day after she left we get our appointment date...September 3rd, they are scheduled to return September 8th. Our attorney has advised us NOT to try to get a new appointment date, as she has had clients where they refused to change the date, this particular example the person was military and NEEDED to deploy. Also we abandoned the CR1/CR2 visas for adjustment of status, BUT the NVC sent all of our original documents to Kiev and we haven't heard anything about where they are now. so i'm asking is it really that big of a nightmare to change the interview date...oh also i couldn't change the interview date, the applicant needs to and she's out of the country. and 2. any clue of our original documents we be at the interview...we really need some advice on this here.

You can try to get the interview rescheduled, but they will often refuse unless you have a genuine emergency. If they refuse to reschedule then she must attend or the AOS will be denied. She should probably plan on returning before the scheduled interview.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

The I-130 packet has long been returned from Kyiv back to the USA... As a part of the AOS process, the USCIS will retrieve the file from storage and should be at your local office when the interview occurs

well let me elaborate a little, the package was sent to Kiev, then we recieved an appointment for the CR1/2 interview but ignored it and adjusting status here with USCIS. does that change your answer? we also incuded the request to return originals with it but again that's the last we've heard of it since late March.

There have been a couple of instances here where people have tried to reschedule their interview, only to receive a letter of denial for not attending their original interview date. This happened even after they thought they had successfully rescheduled.

It's not a good idea to try and reschedule for anything other than a true emergency. Priorities, you know. ;)

The best and easiest way to re-schedule an interview is to make an nfopass appointment at the local office where the interview will be held. They are handling the case now. Go there and explain the situation and ask for a new date. Going through the national USCIS to reschedule a local interview IS a nightmare and is not needed.
