Timeline

Today, I received a denial notice from USCIS via email today and I have no idea why. We have already gotten my husband's EAD and Advanced Parole back in May. We have never received a RFE for anything. Has this happened to anyone else? We have not gotten the letter yet but I am freaking out.

I noticed from your timeline that your case was not transferred to CSC and you were not interviewed. Did you change your address and you did not notify USCIS? Please give more info on your timetine so taht you can be adviced better

Sorry that would probably be helpful if I had that information. We filed the AOS on Feb 22nd, got notification on March 5th, got a letter stating that it had been transferred to CSC. We have not moved from the address and have received everything in the mail that we were supposed to. I did finally get through to an immigration officer tonight at USCIS and after asking questions, finally was told that the email that we have been sent was a mistake (she couldn't tell my why) and that his file had not been decisioned. She said that in the system it did not show that it had been denied. You would like to think that the notifications are correct but I guess sometimes they aren't.

Wow! Thats a lovely mistake to make. You must be relieved but I can imagine the stress you must have been going through in the meantime. Hopefully they can now get your APPROVAL out quickly.

Hey, this is the "D" of GMJDMJ, with some helpful advice for people who have this situation.

If you call USCIS and ask "Why has my application been denied" they will go on autopilot and simply repeat the mantra "You must wait for the letter to arrive. If it does not arrive within 15 days call us" at you until you hang up in frustration. You have to realize that these people have a script for everything from their greeting to their goodbye, they have memorized the script, and they're going to stick to the script.

Don't tell them you've been denied - this will invoke the mantra instantaneously. Ask them for the last activity on the case, ask them if there were any RFEs sent out, ask them anything reasonable that they can't give a stock answer to. I spoke to SIX people who all gave me "the mantra" when I asked why I'd been denied. My lovely, charming, and above all SMART wife called again after my six failed attempts and asked questions which made them actually LOOK at their screen to get the answers. This SEVENTH person actually looked up the case and said "hey, you haven't been denied, there's been no decision on this case yet! Must be a notification error!".

My point is that in order to get anything done, you have to get them to break from the script. The script will give you absolutely nothing, but the person reciting the script has the ability to help if only you can politely, respectfully, and calmly get through to them.

I replied to your message on Facebook, G, but then thought to look here. I'm glad it was an error! When you told me, it made no sense to me so I'm glad they were wrong. But geez - how ridiculous that they could send out something like THAT in error! :blink:

And yes - USCIS 'mis'information line is about useless - scripts indeed. That's about all they can do.

Well, it looks like we are not out of the woods yet. I called our congressman's office today and spoke with the immigration representative. I wanted him to contact USCIS and verify that David's file had not been denied because we had gotten so much incorrect information yesterday. The rep called his contact at USCIS and his contact verified that he had been denied and a letter was sent to us yesterday from California. His contact could not see a reason and said that if it had been for an RFE it would show on his computer screen. He then proceeded to contact the immigration officer who decisioned the file directly to try and find out why. Once he does find out, he is going to contact the rep from the congressman's office who will then contact me. In the meantime, we may get a letter. We have been so upset because we cannot figure out why. We have done everything that we were asked to do and in the time frame requested. At this point there is nothing that we can do except wait.
