Can't say this is surprising, but it is disgusting. Glad to see it doesn't matter what the courts say. Screw our legal system. Screw checks and balances. They matter not! Emperor Obama knows best! Bow before him. Kiss his toes!

WASHINGTON (AP) - The Obama administration will issue a new revised moratorium on offshore drilling Monday, two administration officials told The Associated Press.

Both officials requested anonymity so as not to pre-empt the official announcement.

Last week, a federal appeals court rejected the government's effort to restore its initial offshore deep water drilling moratorium, which halted the approval of any new permits for deep water projects and suspended drilling on 33 exploratory wells. That moratorium, issued following the catastrophic Gulf oil spill in April, was first rejected last month by U.S. District Judge Martin Feldman.

"If some drilling equipment parts are flawed, is it rational to say all are?" Feldman asked. "Are all airplanes a danger because one was? All oil tankers like Exxon Valdez? All trains? All mines? That sort of thinking seems heavy-handed, and rather overbearing."

He said the moratorium "seems to assume that because one rig failed and although no one yet fully knows why, all companies and rigs drilling new wells over 500 feet also universally present an imminent danger."

Interior Secretary Ken Salazar said at the time that he would issue a new deep water drilling moratorium that could be refined to reflect offshore conditions and allow drilling in areas where reserves and risks are known rather than in exploratory reservoirs.

In its appeal, the Interior Department asked the 5th U.S. Circuit Court of Appeals to let the temporary ban stand until it ruled on the merits of the case.

Several companies that ferry people and supplies and provide other services to offshore rigs argued that the moratorium was arbitrarily imposed following the April 20 explosion, which killed 11 workers and blew out a well 5,000 feet underwater.

Screw checks and balances? It seems that the government is adhering to the established procedures. The first one was struck down by the courts and the government appealed. Presumably "revised moratorium" means that they went away to address the areas of concern in the original proposal and will resubmit it.

That's correct, the new moratorium has been adjusted based on the reasoning of the court for striking the first one down. For example ff the government denies you a building permit because your building is 20' to tall, you can either appeal or just submit a new permit with a lower building height.

A just amazes me that a private company can challenge the decisions made by the federal government, appointed by the people, in a courtroom. What a bizarre system the US has.

Next they will be suing to stop paying taxes and will very likely find some idiot judge out of the great state of Texas who will rule in favor of it.

I mean you saw it here. Knee jerk reaction to stop all drilling because things got screwed up with one. Instead of calling for an immediate inspection of all rigs (which was the right thing to do) there was an instant stop put to drilling until they could find out 'why' in their terms the accident happened on that one rig...... That's absurd.

Dude, you guys escaped the so-called tyranny of kings and queens only to adopt a system where the courts call all the shots. In other words, same ###### different smell. The rest of us let nature take its course and adopted a democratic approach towards such matters, leaving decisions in the hands of the elected government. Nowadays, over here, you have private organizations or groups that get to call the shots behind the closed doors of the courtrooms. So basically in America my life is affected and impacted by decision I have no say in or part of. Is that what you call freedom and progress in a civilized country?

The majority of the world also uses civil law, where the judiciaries basically interpret the law passed by legislature. Whereas, former English colonies tend to use common law, where judges get to apply the law. While AUS has the same system, the parliamentary system allows for the government in office to be able to govern, than ask permission from the courts. Evidently this is being abused and exploited here, as judges clearly rule based on their ideological viewpoints rather than being impartial. An excessively alarming amount of power is yielded to a judges who get to decide on the fate of their town, city, state and the country.

While I am no expert on this, the eye-raising differences stick out like a sore thumb. Evidently the tyrant here is your judicial system, whom we all must bow down to no matter what.
