then my other question is if she got pregnant in China from me would i need to be there when the baby was born to prove our love even more?

thanks for everyone in advance this is a dicy idea : ( fact is i wouldn't want to do this to her any but shes more then willing for our love.

1. False, just because she is pregnant from a USC does not mean she can marry and become a citizen..Im pretty sure that is Fraud as it is illegal to go to america wth the intention to get married on a tourist visa. You would ahve to file for a fiance visa, then get her to come over and get married. If only it was that easy it sure would be nice. Whoever told you that was giving you false hopes, sorry.

2. Is she already pregnant? Why not just do the whole get married in china you go back to america and then do the CR-1 or get engaged file for K1, she goes to america you get married and after all that have a baby? Im not sure just being there at birth will prove your love

With the CR-1 If you went over there as the USC get married (you would have to find out if there are any rules for china if they require you to have any documents or if you can just have your passport) you would have to come back to the US she would have to stay in China, you would file for the CR-1 and then when that is done and you get approved she can come and live in the US and will recieve a Green card and SSN. She can still visit you while you file the CR-1 though.

The idea that by physically being in the US at the time of conception automatically authorizes a non-USC female to be eligible for citizenship is utterly false. What it does mean is now there is a baby in the picture with only a chance of immigration being authorized. I can't speak for the USCIS but if she's going to have your baby it would likely mean the world to her if you were there. Good luck on your journey.

p.s. Go smack your friend upside his head for all of us! Advise like what he has suggested to you causes lots of problems.

If you have the needed entry documents.... That is a difficult task for someone from China... Not so much from a country who participates in the Visa Waiver Program, which China is not.

YMMV

Just a correction. It is not illegal to come to the U.S. on a visitor visa and get married. If it was, there's a lot of chapels owned by Elvis in Las Vegas that would go bankrupt. What is illegal is to come to the U.S. with the intent to immigrate.
