Urgent questions about I-864

Hello, I do have several questions about I-864 form.

My husband's income in not enough to support me, so he found me his friend to be my sponsor too. Is it correct that:

1. My husband fills out I-864 form?

2. His friend fills out I-864A form?

3. His friend's family/friend uses I-864A form??

And, can we apply fee waive when file I-130 form??

the i864A is only if he lives in the same house. if not he has to fill another i864. Your husband would mark that he is the sponsor on his i864 and his friend would mark I am the only joint sponsor on his i864.

the i864A is a contract between the sponsor and a household member.

Thanks, how about the Q. 3?

Also, at the top of right hand side (I-864), it has a number: OMB No. 1615-0075; Expires 10/31/10, does it mean this form only valid until 10/13/10? After that date, I cannot submit this form???

If you husband's friend makes enough money to meet the guidelines based on his household size than question 3 does not apply to you.

Q1: Yes you husband fills out I-864

Q2: Your husband's friend fills out I-864 also, unless you husband and his friend lives in the same place than it's I-864A

Q3: If the friend makes enough than there is no need for Q3, how does the friend file his tax? Does he do a joint tax return with his wife?

Fee wavier are very hard to get approved...but you can try it. The link below has more information about it.

4/14/2010 - Email sent to NVC with "Choice of Agent

4/19/2010 - NVC email confirming "Choice of Agent" email (~5 days)

4/20/2010 - NVC email with AOS and IV bill

4/23/2010 - AOS fee paid & package send

4/26/2010 - IV fee paid

5/21/2010 - IV pack mailed to NVC

5/28/2010 - NVC received IV packet

6/10/2010 - SIF & RFE (for PCC different for Sir Lanka)

6/11/2010 - CC (with RFE)

Applying for a fee waiver is to testify against your spouse's ability to support you. It will NOT be granted and WILL hurt rather than help your process.

thanks for all your replies, my husband is currently in the prison. He's a lifer and we got married in the prison at last year. So it's why we want to try apply fee waive.

Forms are changed and updated from time to time. On the day you are submitting the I-864, check to see if there is a newer version. If there is not, then send in the one that you have.

ie: always use the latest version provided.
