We sent our initial K-129F petition and materials in last month, and received the NOA receipt with a date of July 20, 2006.

However, looking again at all the information on this site (which I didn't find BEFORE sending all the stuff in, unfortuantely), I realize the passport photos we sent as required for the G-325A forms (bio data sheets) might be too small. the top of the head to the chin size requirement is met with what we sent, but the total dimensions of the photos are less than 2x2 inches. I guess we sent ID size rather than U.S. passport size. I didn't know there was a difference.

Quesitons, then:

1. If the photos were not acceptable would they have already sent the packet back to us to resubmit? Does reciept of a NOA mean that we are OK?

2. If not, has anyone received notice at the later stage (processing the K-129F) that they needed bigger photos?

3. Should I send in new photos with a cover letter and the reciept number I received?

Thanks for any advice. I feel doomed already!

The photos I sent with the I-129f package were too small. I did not get an RFE. It did not cause any delay or problem.

If you have received the NOA-1 already, then you are fine. Had they needed the correct size passport photo, they would not have sent you the NOA-1.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Not true. The NOA is only an acknowledgment of receipt, not a verification that all of the documentation and evidence is complete. There would be no need for RFEs in that were case.

I too agree that NOA1 is basically a notice that they have recieved your package. If they think they need more evidences or correct info, they send you a RFE. If you have recieved NOA2, you have nothing to worry about.

Not true. The NOA is only an acknowledgment of receipt, not a verification that all of the documentation and evidence is complete. There would be no need for RFEs in that were case.

Correct. Short rundown.....When a petition is first received by the service they date stamp the petition, check to see if the petition is eligible to be filed (ie a USC), that the petition itself has a correct signature, and that correct payment has been made...once entered into the system in the 'Data Unit' an NOA1 will be generated and issued. The petition and accompanying documentation and evidence is then sent to the Work Distribution unit to await processing/adjudication. This is when and where RFE's will be issued for anything not completed fully or satisfactorily, missing documents, or further evidence etc

USCIS is not as picky with the passport photos as DOS (department of state). One should never send anything to the service center that has not been asked for. Always wait to see if you are issued an RFE first.
