1040 tax return for i-751

I just realized after reading some posts here that they have submitted tax transcripts or 1040 copies with W2's. I didn't add any w2's with my 1040s. Will this be a problem? the package was already sent out :( Thanx!

The normal course of action is to get an RFE. However, when we mailed our package, we also forgot to include the W2s and we got approved without an RFE. If your evidence is sufficient, then they might over look this minor missing document.

In the meantime, why don't you go ahead and request your tax transcripts - they are free. It takes them a couple of weeks to arrive, and if you do end up receiving an RFE due to missing or incomplete tax transcripts/returns, then they are there and ready for you to copy and mail back. If you don't get an RFE, well then you can keep them for naturalization... if you want to apply for naturalization when you become eligible, then you need to submit tax transcripts again so they will be there and ready for that phase as well.

I am still a little uncertain on this as well. I just posed a separate question on the topic and although I have received partial answers I am still unclear on some points.

To obtain IRS transcripts we need to complete Form 4506-T (request for Transcript of Tax Return).

What do we need to input in part 6 (Transcript Requested)? Obviously "1040" for most of us, but I mean: do we tick 6a (Return Transcript) or 6b (Account Transcript)? (We did our joint tax returns on time each year and both times we got a refund from the IRS, no penalty/adjudication scenarios etc). What does USCIS need?

And furthermore do we also need to tick Part 8 (Form W-2, Form 1099 Series, or Form 5498 series transcript)? My understanding is that is needed only if one loses their own W-2s etc. and need the info there. :wacko:

Thanks for the input :) I guess I will probably do so in the end. Unfortunately we don't have a fax machine or indeed a phone line for that matter :(. We have separate broadband installed in the building. We use our cellphones instead for everything, even as a doorbell...

But apart from this, it would be nice to know how one is meant to complete this form. I believe it could come in handy in future.

Does this mean I am the only one who has attempted to complete a 4506-T? LOL! I guess I feel ... "special" :>

I disagree with the posters so far. The 1040 covers it totally; absolutely no need to add W2 or 1099 forms. Forgettaboutit!

I've read about 6 cases of RFE or requests for W2s in the last few months during the NVC and interview stage.

I'm not sure about the AOS/ROC procedures but it was definitely asked for during my interview.

Yes - there some members who have sent in their 1040 forms and received and RFE requesting Tax Transcripts since parts of the return were missing. I beleive up to this point, all our answers are based on what we think... and not what USCIS clearly states what is needed. Meaning, people who received RFEs for tax returns/transcripts claim that they didn't include everything - just the 1040 form so it is tough to say.

Once again, we forgot to include our W2s but included all forms and we didn't get an RFE... so at the end, it is up to the OP to decide what to include and what not to....

Timeline

Quite possibly USCIS asks for such extras when there is some question about there being enough income to sponsor. Income is not an issue at the I-751 stage; only proof of a continuing bona fide marriage.
