Either party can max out the credit cards or drain every dollar from the bank account. If his ex max's out the credit card HE is JOINTLY liable for that debt. If he puts $10,000 in the bank account and she takes it out, he has NO recourse against her, because any money put in that account belongs to them BOTH.

the best thing for him to do is close that particular account and open a new one, end of the problem...

yap yes, thats better for him to do but now i am waiting that he can do some idea about closing the account..

its really hard in My part though..

Guys, what do you think in this situation of Our marriage, still wondering WHY until now the X-of My Husband still on HIS account in the BANK,and everytime that I ask Him(Husband) can't be deleted/erase in the record because that is the policy in the Bank..they divorced 2005..and they are joined on it.

And My question is Is that really the policy or regulation in the bank here???once your wife is in the secondary of the account you can't easily delete her name??I am the legal wife now so I have a right to ask about it!

We tried to open a new account and I am the primary on these new Bank now and He is the secondary..but all the money is there (original bank account).

NO. It is not true. Your husband cannot remove HER from the joint bank account, THAT is true, BUT he can take his half of the funds, (or whatever was determined to be his by court order)remove HIS name from the account and open a new account in his name our both your names. He can do this anytime he wants. He should have removed himself from that account immediately upon getting married, there should be no reason to have a joint personal checking account with an ex-spouse.

Actually since it is a joint account he can take ALL the money if he wants, but I would make sure you do not violate any divorce decree provisions.

Your husband is lying to you if he is telling you this, find out why.

That's why they ask for a driver license number along with the SSN when you open a new account. If you left a bank without paying the overdraft, you get put on a list and pretty much black-balled for about five years.

Barring that explanation, I know of no reason not to simply move the funds and open a joint account with the current spouse.

When my ex and I divorced I just had to sign a paper stating I wanted to be taken off the account, and that I did not want any of the money in the account, that was it, very simple

I'm talking about your husband's ability to open a new account in his own name. When opening a bank account, the driver license is used to reference information in a banking related database. Based on what they find, they decide whether to open the account or not. If they find he doesn't qualify based on some past issue with a bank account, they won't open a new one. If they won't open a new one, your husband must choose between no bank account and the joint one already open. I'm not saying this is the case. I'm just pointing out that it COULD be the case. If so, your husband will probably know. The only way to be certain is to attempt to open a new account.
