Child U.S.C. Parents not!!

Hello all.. My friends are not U.S.C, but there 2 year old is a U.S.C. The Child at this time is out of the US with the parents. How can the parents come to the US? They would like to move here to work. I don't know what to do or what to tell them... Any help on what to do?? By the way the child was born here when the mother was on visit to U.S.

2005---We met by friend/Church member that was living in Nigeria

2006---We begin to talk about getting married

2007---I was going to met him face to face, but hurt my back couldn't walk..

2009---Was able to see each for the first time.. I got my engagement ring (WOW).. :wow:

2010-01-22 mailed I129f

2010-01-26 got NOA1

2010-05-12 called to see why no NOA2, I was told that our case is not being processed yet!!!!! No notes in the computer

other then the mailing of the NOA1!!!!!!! :angry:

2010-05-18 called SERVICE CENTER again to see what's going on with our case.. NOT BEING PROCESSED YET I WAS TOLD AGAIN!!!

2010-06-16 Got notice that NOA2 was approved 141 days after NOA1. We got our approval on Ossy's Birthday.. Happy birthday honey, I love you!!!!

2010-06-21 got NOA2 in hand

2010-06-22 called NVC to see if papers was there, but was told that my DOB was not right in the system. Just mailed a letter along with a copy of my birth certificate asking to change my DOB.. Way to go VCS..

2010-06-22 NVC received the case

2010-06-23 Case sent to Embassy in Barbados

2010-06-28 Embassy received our case

2010-08-09 Interview Administrative Review

2010-11-15 Approved for Visa (I was on the mission to make sure the INTERVIEWER that we had never interviewed anyone else and I did it).. Know that you have right and don't let the interviewer cross the line..

2010-12-10 Visa and Passport in hand!!! Thank God!!!

2010-12-19 Ossy will enter the States!!

There is nothing they can do until the child turns 18 years of age, and then the child can file for them.

correction, the child has to be 21, 18 is only for marriage. the age of a USC to petition family members is 21.

Your friends would likey have to qualify for some form of employment based visa if they want to have a shot at working in the US.

Your friends would likey have to qualify for some form of employment based visa if they want to have a shot at working in the US.

Visiting is one thing, coming to the US to work is a whole other ball game.

Okay, now the fathers mother has been in the U.S. for about 15 years now. The baby is living with the grandmother, so right now she is trying to see how to get them here.

Okay, now the fathers mother has been in the U.S. for about 15 years now. The baby is living with the grandmother, so right now she is trying to see how to get them here.

Question: Is the father's mother a USC?

If the father's mother is a LPR, she can file but the wait for an available visa can still be anywhwere from 5 to 10 years. All of this information is posted on the USCIS.gov website.

Is the couple legally married? If so then if the Father's mother is a USC she can file for them, if not a USC then she will only be able to file for her son.

If the father's mother is a LPR, she can file but the wait for an available visa can still be anywhwere from 5 to 10 years. All of this information is posted on the USCIS.gov website.

If the Father's mother is a LPR, then she can only file for

A permanent resident of the United States can file a petition for the following relatives:

Husband or wife; and

Unmarried child(ren), regardless of age.

Note: Only U.S. citizens may petition for married children.

When you submit your petition, you are required to provide evidence to prove your relationship to the person for whom you are filing.

The father's mother just informed me that she is working with the School District where she is employed to see if maybe they can hire them on as Teacher's so they can file the paper work. I just know that they are working my last nerves :bonk:... I think she need's to let the baby stay with the parents.

Well there is no shortage of Qualified Teachers in the US and most School Districts are strapped for cash so even if the disctrict agreed how would they cover the expense and explain hiring two teachers from overseas?

I was just reading the http://travel.state.gov/visa/immigrants/types/types_1323.html to see what all would have to be done by the School District. I don't know if the District would pay it or have them to pay the expense for filing. I think the mother is trying all she can to have them with her. She has cancer the beginning of stage three..

This may be a long streach trying to obtain visas regarding employment as teachers for a school. But good luck to her.

I do wish them the best myself. I just pray that she leave the child in Nigeria with her parents. My back is not healed from my surgery this week. I can't help her see after this baby when she's to sick to care for her.
