I got married in 2008 and she filed an i-130 and i485 for me but because we had a shaky relationship during the interview she withdraw the petition without me knowing at first i just found out when i got the decision that it was denied because the petitioner withdraw the petition.

And she filed a divorce after that i got court date for my removal but i got married prior the master hearing. Now because she wont tell me what actually happened or what trigger the withdrawal i dont know if she said that it was fraud or what? so i requested a FOIA which shows no fraud and and the decision letter says it was not fraud. Is it possible that they will charge me fraud once my wife files a petition for me?(THOUGH MY EX WIFE SAID SHE SWEARS SHE DIDNT SEE ANY FRAUD IN THE PAPER THAT THE IMMIGRATION OFFICER TOLD HER TO SIGN)

Fraud or not fraud - you were placed in removal proceedings - (to mirror what Darnell said) you should definitely be securing a qualified family-based immigration attorney to represent you. Do not attempt this on your own (in my opinion).

He/she can give you specific advise. (There are really so many details none of us know - type of visa you entered on, circumstances of your marriage, and the reason for the AOS denial itself - for example.)

Generally you can not adjust whilst in removal proceedings. But I agree on the Lawyer.

His prior posts reveal much, but - way back when, he had a lawyer for his AOS - and I'm confused - if any 'guarantee' on lawyer's work - a deportation hearing would be bad karma from that lawyer. IMO, worth a read...

But - seriously - that lawyer should step up, or at least be contacted again.

He's in the throes of a removal process (I THINK?)

but he's asking if his NEW WIFE files a new AOS for him, will the deportation process (from prior AOS attempt) be stopped... I THINK.

I will say this - if prior wife paid for that lawyer, I sense that lawyer won't be so eager to talk with him again. I could be wrong, of course.

So basically you got married for the 2nd time sometimes between the divorce decision and the hearing for removal proceedings?I am afraid I doubt you are eligible to re-apply for AOS or at least your chances to get approved are close to 0, especially if the answer to my question is "yes". Your 2nd marriage will not attract a lot of credibility. Anyway, you need a very good immigration attorney!
