Hello VJ world,

Part 25 Federal income tax information. There is a check box stating "I have filed for Federal tax return for each of the three most recent years". I have filed tax returns for the past two years but not three. Now, because I am the primary sponsor and my joint-sponsor will be providing his last three year tax returns, should I not even worry about trying to submit my last two year tax returns and leave the box un-checked?

11/10/2010 - Service Request response via email - they say to wait 180 days for notice of action. My response - I state politely that their request is unacceptable and inform them that I will contact my senator if I do not receive an appropriate response within one month's time.

12/2/2010 - Their response to my email - I will receive notice of action in 35 days.

12/16/2010 - GC mailed.

12/20/2010 - GC received.

Why didn't you file? Is it because you weren't working then? You will need to include a letter of explanation for why you didn't file that particular year.

You MUST include all your tax information (meaning last 2 years as well as the letter of explanation), whether you have a joint-sponsor or not or you WILL get an RFE asking for that information.

I didn't file in 2007 either, since I was a Peace Corps Volunteer and only made about $3500 for the entire calendar year. I included a letter explaining why I didn't file, my 2007 W-2 from Peace Corps, a completed income worksheet from Peace Corps (since volunteers get extra money not included on the W-2 which must be calculated varying by country - I also included the Kenya page showing how much money that is), and a print-out of the 1040 form instructions saying you only had to file if you made over x amount (over $5000 more than I earned that year.) Try to include SOME kind of info about why you didn't file - if you have any W-2 from that year or can explain by saying "I was a student, I didn't work at all that year," and maybe provide some kind of documentation that you were in school, etc. would be helpful I think.

Just provide a written statement explaining why you didn't file taxes and provide reference to the IRS rule that allows your reasoning.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
