Hi everyone!! I just discovered VJ, maybe I'm a little late to the party but oh well! First of all I will introduce myself- I'm Lara, an American woman, and my fiancé is Patrick from Montréal, Canada! We met in December 2006 and now we're getting ready to send our package.

I wanted to ask, is there anything I'm missing from mine? I'll post a list here of what's inside:

-Cover Letter

-1-129F

-Payment of course

-G-325A and passport style photo (Petitioner)

- G-325A and passport style photo (Beneficiary)

- Birth certificate (Petitioner)

- Letter certifying intent to marry (Petitioner and Beneficiary)

- Proof of having met in person in the past two years in the form of photos and color-copies of airline and train tickets. Phone bills also offer evidence that the petitioner was in Montreal, QC on three (3) occasions within the last year: July 27-August 6 2009, December 24-December 30 2009, and March 24-March 30 2009.

- Proof of ongoing relationship in the form of photos, copies of phone bills dating from March 2009, and copies of dated e-mails.

- Affidavit from local court showing consent of legal guardian for Petitioner. Although I will turn 18 in June, we want to send the package ASAP to get the fastest results.

Also does anyone have experience with that?? Would it possibly be better to just wait until after my birthday has passed, or will it not affect the USCIS decision? Thanks a lot.

Lara, you are 17 and have put together what appears to be a thorough packet. I don't know if it would be better to wait until after your birthday, but if folks approached it as well as you seem to have there wouldn't be as much to talk about in this forum.

I want to add a couple of things. First I do agree with Alcheringa that you have done a very good job, you seem very well-organized and thorugh.

Ok,

1) Yes, you will need the Affidavit of the Court showing Guardian's consent unless the legal age of marriage in your state is 17 or lower. The requirement for the USCIS is to make sure you both are eligible to marry so what you need to demonstrate is you are either of age to marry in your state or have consent of parent or guardian.

2) Are you aware after the I-129F petition is approved, that your fiance will need to interview at one of the US Consulates in Canada. For that interview, you will be required to provide an Affidavit of Support (known as the I-134) to show you can provide for your fiance (future husband) and keep him from becoming a Public Charge (relying on Welfare, TANF, Food Stamps, other public assistance). If it is just you and your fiance you will need to show an income of about $18,212.

There is a possibility of finding a responsible person (known as a joint sponsor) to help you with this issue.

High Laura,

To play it safe I think you should wait until your 18 and legally able to marry. Other than that it sounds like you have put together a good package. If you want you can use my packet as a reference point. I made a video of its contents and put it in my blog. The link is in my signature.

Thank you all very, very much!! I have a lot of support coming from my family (wish I could say the same for Patrick!) and they've made this process a little easier to manage. I'm so glad I found this website, it just helps me double-check everything in my package because I REALLY don't want to have a RFE or something like that!!

On a note about the Affidavit of Support: actually, I think make enough that I don't need a co-sponsor. I know I'm 17 but I graduated high school early and I'm now working as a Certified Nursing Assistant. I read that I have to make at least 18,000$ a year to support both of us? As long as that is the case, I'm good. And as long as I don't have to have 18,000$ in my bank account. Because that, I don't have yet.

Hi Lara,

Yes, your income is good at about $18,212. You sound like a very well grounded young lady. I do not wish to worry you, and Canada has good Consulates in that it is not a high fraud country and they will not give the beneficiary a hard time.

Have you filed a tax return or more than one before. While you have a good job and are earning, I am not sure about the ability to show past records. You do not need to have a large bank balance.

I think you will need AT LEAST:

Letter of Employment

Pay Stubs, 6 months would be good in this case (since you are young, sorry)

Tax Returns with W-2s "OR" Tax Transcripts (1 - 3 years)

Maybe copies of one year of Bank Statements (not necessary if you earn 125% of the poverty line but in your case again I would recommend this).

Hi Lara,

I derailed the original topic from your I-129F petition into an I-134. I am sorry, I should not have done that. I think your I-129F package and documentation are solid and you will not have any problems from what you have said. I just wanted to point out where I thought it might be a little more difficult in the next steps after the I-129F.

Nice to meet you and welcome!

I was like you...double and triple checking myself on the petition. If you follow the guides on the forums (there is a link at the top) exactly, you should be good to go.

One bit of advice, make sure you read through ALL of the sections of the guides for a K-1 Visa. Sometimes something in them will read one way and when you get to the "next" section of the process it is a little different!!! :)
