I received an RFE today :crying: :

"In order to process your application further, the petitioner/sponsor on Form I-864, Affidavit of Support must submit all Federal income tax documentation submitted to the IRS for the most recent tax year."

I originally sent in my W2 along with this year's tax return, but I didnt send in my 1098-T form because in the I-864 instructions, it asks for W2 and 1099 only.

Do you think its better to send the IRS Tax Return Transcript or the 1098-T along with the W2 and this year's tax return?

Also, I have 2 joint co-sponsors...my dad and my aunt.

I have not received an RFE for them yet, but they filed married-joint tax returns and we only sent the W2 forms for my dad (not my mom) and my aunt (not my uncle).

Should I include my mom's W2 and uncle's W2 as well?

IRS transcript is always better.

As you didn't receive an RFE for your joint sponsors then I wouldn't bother with those. You mom and your uncle aren't sponsoring you so there's no need to confuse things by sending their information but it couldn't hurt to ask your dad and aunt to order IRS transcripts and send those along as well, "just in case".

Oh,Nartaki! So sorry! I think also you better go with IRS official transcripts. They are free and now they can be ordered for less than 2 weeks.

I think it's more reliable than collect all W2s and stuff. And you won't loose with transcripts!

Regarding W2s for mom and uncle, they believed the info you sent in was enough but if you worry then better attach.Anyway you will send them a response.

Yes. Right away as they decide to send a RFE your case status will jump to "RFE". But you won't know the reason until you receive the letter.

Why do you think you will get a RFE?

You wont know what the RFE states until you get the letter. I called the USCIS Customer Service and they wouldnt tell me either, even though they knew.

I will be sending off the RFE tomorrow: just the transcript of my tax return. I just hope theres no more RFEs :(

Why do you think you will get a RFE?

Is it really? Natarki? Is it showing "Request for more evidence" ?

I did not attach my tax return cause I hadn't filed yet while I submitted my application.

However, I attached my joint sponsers.

Kerrin, I would just be prepared with this year's tax return transcript. So if your RFE comes, you can send it off the next day to avoid any delays. Yes my status still shows "Request for Further Evidence"

I got a letter asking for initial evidence regarding the I-864. I sent in my sponsor's recent tax returns (2007,2008,2009) only.

I called them and the lady told me to send in the return again.

Well my case maybe different but I think it's better to send something that you have filed or official.

04/16/2010 - AOS , EAD. AP Mailed via USPS priority mail

04/18/2010 - Received - via USPS delivery tracking

04/23/2010 - Both checks cashed by USCIS

04/26/2010 - Received 4 NOAs (I-130, I-485, I-765, I-131) in mail.

04/29/2010 - I-130, I-485, I-765, I-131 have been touched.

05/03/2010 - Biometric letter received, scheduled on 05/19/2010.

05/10/2010 - RFE for I-485, 864. Need to find out what I did not send.

05/19/2010 - Biometric taken at San Antonio.

05/19/2010 - Touched on I-765.

05/24/2010 - Sent in additional information to USCIS.

05/26/2010 - USCIS received my additional information.

05/28/2010 - USCIS resumed processing of I-485.

06/02/2010 - Address changed using USCIS website.

06/07/2010 - I-130, I-485, I-765, I-131 have been touched.
