Ahh, don't stress! I'm sure you'll figure it out.

We didn't send anything about MY taxes - we just sent my parents' forms since they're the cosponsor. So, I haven't talked to my attorney at all about it. Sorry, I don't have much advice. I think he's out of town this week (perfect timing!) but if not, then I'm going to call as soon as we get our RFE (and confirm that it's the same issue) and see what he says. I'll let you know what I find out.

I don't think there's any harm in sending the tax transcript and then if they send another RFE, you'll have the verification of non-filing by the time you get it. If it doesn't work, then you'll be ready to go when the you get the RFE so it doesn't seem like it could hurt. But I'm not sure!

Funny, I just graduated from law school (and took several immigration related classes) and I still find the process confusing.

Let me know if your RFE is for the same thing when you get it.

You are right, I will probably try to get the tax transcript for 2009 saying there is no record at IRS tomorrow and then send that in with the statement and see if it is enough. You would think it would be since we have a co sponsor and they have her tax returns from 2008 & 2009 (they didn't ask for any more info for our co sponsor either). If not I guess I will get another RFE for more info :girlwerewolf2xn: But I don't want to wait until the 15th. Guess I could get one for 2008 and send that one in too with a note saying the 2009 is not available yet. What do you think?

There seems to be a vast number of RFEs regarding tax returns... All the best to fixing these issues. Remember u can also submit Tax transcripts that erases the need for W-2s...

Yes, the RFE cbriner (and SweetApple?) had was for 2009 taxes but the one I got (and maybe Leigh Ann too) is for the USC's taxes, and in our cases the USC did not file any taxes and we both have co sponsors which we have already submitted tax info for. :huh:

What do you mean? We are all family here, right ? :D They are asking for the USC spouse's info. In my case my husband doesn't work (full-time students) so he has not filed taxes for 2008 or 2009 and we sent a statement explaining that. I sent my co-sponsor's tax returns and W2's for both 2008 and 2009 and they didn't ask for anything more from my co-sponsor in the RFE.

If I am reading correctly you are the USC and not your husband, which means they are asking for tax info from the beneficiary, not the USC/sponsor??? :unsure:

And how come your lawyer is telling you to send the same stuff you already sent before?

IMO you should try to provide more evidence than your original documentation.

Yeah, now I won't get the actual RFE until tomorrow. It is my husband who is the USC, so he is the sponsor. Then we have a co-sponsor as well since my husband is in school full-time.

Why my lawyer is saying that just proves that it (sometimes) is a waste of money getting a lawyer when you have VJ! I had to tell her that I know from other people's experience that it is better to send too much. She also said, well we got 87 days to respond to the RFE. That really got me upset! I was like Hey, listen, I don't want any more delays and I'm not waiting one day extra just because I can!! :protest:

That sounds like the best bet - just get something in ASAP (that's what I think, just because I know how anxious I am to keep the process going!). It can't hurt, I don't think.

I know that would solve all of our issues the tax transcripts, but we were the lucky people who filed taxes for 2009 at the same time we filed for AOS. If I had known that my visa number would become current to file for AOS I would have filed 2009 taxes January 1rst 2010 LOL :whistle::D oh well then ... will make it I hope, do they accept tax transcripts that are only mailed or they could also be faxed? (F)(L)

Exactly! :ranting: I'm collecting documents right now. I called the 1-800 number and pressed on all different numbers until I got to a live person who said that they could not help in specific cases but if I submitted something that showed that he is a full-time student and that he didn't pay taxes that should probably do.

So now I got:

- His degree plan showing credits he took in 2008-2010

- His credit grades for 2008-2010

He is going to IRS right now to get:

- Tax transcript for 2009 (says no records of taxes filed)

- Verification letter of non-filing for 2008 (they are not available for 2009 until June 15, but I told him to ask if they could write a note saying that)

What do you guys think? The school docs. are not official, I printed then out from his online school account so they still have his information and the schools info on there. I just think it takes a while for the school to give him the official copies.

From my experience it shouldn't take much time to go to the registrars office @ school and ask for enrollment verification.

Official transcripts, yes, those take a few days.. but enrollment verification should be easy and IMO better than a print-out from website.

I've done it and I think you should be able to just walk up to the registrar counter and within minutes they should be able to give that to you.

But maybe every school is different. Can't hurt to try though right?
