First of all much appreciated for all the help so far from everyone. :star: I do have another question though. Because I got married and I quit my job that I had just before I got married, (went to live with my husband in canada) I don't have a job right now but my dad would be my co-sponsor he makes the amount needed by the poverty line...... Can I begin the paperwork ( CR-1 stuff) with me not having a job? Would it make a difference on approval of my paperwork, not having a job down on the paperwork...

My parents combined make $67,250 a yr..... can I use both together or just one? :huh:

domiclie? ....I'm a U.s. citizen and i'm married to a canadian citizen. We got married in California on September 26th, 2009 (he came down and his family for the wedding)..... after we got married I went to live in Canada with him and we recently decided to move to California. I've come back to the u.s. to eventually find a job and apartment....I didn't file any paperwork when i was in Canada. My status in Canada has only been visitor.

Oh, I thought you were still living in Canada and filing for DCF.

Yes, being in the US and having an apartment/job is sufficient domicile.

You can use the parent who has more income.

Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.

For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence.

I see.... I just want to make sure that it won't matter that I'm his wife and I don't have a job or apartment but one of my parents will be the sponsor.....it's totally okay that I won't be? ..until i find a job god knows when in this economy =/

Well, there are logical issues like how/where are you going to live, pay the bills etc which the CO might very well touch upon. It's one thing if you don't meet the poverty line but are hovering around it and another thing not to have a job/source of income at all. Do you have any assets that you could show?

I'd talk to some of the Canadian members. They might be able to better guide you. Montreal, from all accounts, is not a tough consulate.

You have about 6-8 months. Redouble your efforts to find a job. ANY job.

We would live with my parents, They have a source of income that is more than enough....and yes I would totally still be searching for a job.....i have been and I've beeen trying so hard I have a little connections from the job where i used to work and they prob wouldn't hire me until the late summer when business starts picking up....they are cutting hrs everywhere here in cali..... ughhhhh.

Montreal is VERY picky about the US citizen establishing domicile in the US. This means having a job, a lease/mortgage, utility bills, etc. If you go live with your husband for the duration of this process, which will be a year, certainly expect the consulate officer to ask about your domicile in the US - and yes, they are really that picky.

The last thing you need is for the visa to be delayed weeks or months while you return to the US to give the consular officer what they are asking for so the visa for your husband can be issued. If you are aware of this stuff now, you can be proactive

Domicile has been a thorny issue at Montreal for the past year or so. Reading the links provided above will help immensely. Familiarize yourself with the evidence that proved most successful in approved cases and start preparing now. Good luck!

If you are all part of the same household, living together you can combine incomes. Otherwise, ONE parent can act as the joint sponsor. Pick the one who qualifies based on their own individual income. This is covered in the excellent instructions provided with the I-864. You are NOT doing your homework. You do not need a job to file the petition. Did you not notice that there is no mention of income evidence in the I-130 instructions and no question about it on the I-130?

We are using our assets to qualify, but we also have his dad's affidavit of support to turn in in case the CO asks.

You do not need a job to file a petition, just a co sponsor. Also, as Sachinky said, it's good to have a plan if the CO asks you about supporting your husband and everything.....

In my opinion you should be fine with your parent's support =)

This is a misleading answer. You need nothing financial to file a petition except the filing fee. Whether "parents" plural can be of assistance depends on the circumstances. I think this petitioner can find a way but for now, she can go ahead and file the petition and look for a job. Thing may change significantly before any affidavit of support needs to be provided.

yeah I think it's best to file the petition for now and continue to look for a job........besides I don't want to live with my parents....marriage is about living on your own at some point :star: It should be better towards the summer...fourth of july, graduation, mothers day. as others said, you're fine to file with using your parents as a joint sponser, just be advised that if you're still in Canada with your husband at the time of the interview, you most likely will be denied and have to prove that you intend to go to the USA.
