A friend of mine is having a hard time with her husband. He became an alcoholic. Yesterday, he assaulted her and the police came in and arrested him. She'll be filling for a divorce. She has been married with him for two years. She told that she have a green card that's going to expire in October. If she divorces him now, what would happen to her immigrant status ? thx for the help.

She should file I-751 for removing condition by herself now. Normally filed jointly but her case is different. Please correct me if I am wrong.

As stated she would file for ROC based on a bonafide marriage to a USC. She will need to get her divorce started ASAP. She will need to remember to file for ROC in the 90 days prior to the GC expiring. She would complete the paperwork as if the divorce was final, but as she doesn't have the divorce decree she will get an RFE to ask for it. This is the only way to ensure that she protects her status. Once the divorce is final then she would send in a copy of the divorce decree. That's the condensed version anyway.

Here's the ROC guide: http://www.visajourney.com/content/751guide
