I am about to send our AOS Doc's (Ki & K2). Now, i still got confuse how to fill-up this I-864(of my Hubby). We have a Co-sponsor which is my friend, her I-864 already fill-up thru the help of Bobby+Umit (thanks for the quick reply).........anyway, my hubby is about to fill-up the I-864...he doesn't know how to fill-up on part 5. In our household, we 4 inside the house (me, my son, my hubby & my stepson). So in part 5 how he would fill up as follows:

21.a -------------- He will put 2,right? Since it is me and my son. Am i right?

21.b -------------- This is u standard as 1,referring to yourself being the petitioner,right?

21.c -------------- Since we are married, of course he will put 1,right?

21.d -------------- Now, since he got a son and stil living w/ us, of course he will count him as 1 too,right?

Now so confusing becoz the total is "5" already where we're only 4 inside the house!......or maybe since it says don't count urself twice, i guess i rather not to put 1 in 21.c since he is the petitioner already it refers him on 21.b, am i right?...i am ready to send this...help me plsssss..thnxs again...hope anyone can help me this out...thnxsssss

You're instructed not to count anyone twice. So you are being counted twice. So, take the number off of the "spouse" line.

December 23, 2009: NOA1!

yeah take yourself off spouse....the lines above tell you to count you and your child under the immigrant portion. It is kinda confusing and I had to read it over and over again...but in the end you wont be counted under the spouse.

If you read after line A...there is bold saying:

Persons NOT sponsored in this affidavit

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

It says QUITE clearly and in bold text at the top of that section "DO NOT COUNT ANYONE TWICE". As you know because you have a co-sponsor, this form is also used for people who are NOT the spouse of an immigrant which is why that option is there. If your co-sponsor is married THEY would put a 1 there, if they're not it would be a 0.

As you are already counted in the "immigrant section" and as the wording "DO NOT COUNT ANYONE TWICE" is there, you of course DO NOT count yourself as his spouse, you are counted as the immigrant.
