I am filing a CR-1 for my wife. I was previously married, divorced in 2004. My question is: When it asks my marital status, do I mark married or divorced? The marriage hasn't been registered in the states yet, but has in the Philippines. I know I am technically married, but what should I mark on the form?

Since you are applying for your wife, why would you mark 'divorced'? That is just going to confuse everyone!

You are married, married is married so mark 'married'

As long as your marrige is legally recognized BY the US then you are golden. Check married. I assume you have some document that shows your union together is legal and accepted.

If the marriage is not legally recognized, then you either need to get married again legally or file I129f :blink:

The US recognizes Filipino marriage licenses, so it's all legal. We have the certified NSO copies of the marriage certificates too, so I will leave it checked MARRIED. I am just double checking eveything before I mail the package out. I do nnot want an RFE.

You will never need to register your marriage in the USA. If you need to document that you ARE married, use a copy of you PI marriage certificate.
