Hello, I recently recieved an email stating that my case is now at the request for evidence status, I filed with a lawyer back in december, and included many pics, chat history, western union receipts, emails, plane tickets, bank statements, intent to marry, birth certs, you name it we made sure we had it in there, I havent recieved the letter yet but should in the next couple of days and am wondering, what it may say? and how long does this delay the process? They told me that once i send the packet back with the info they need I will get my spot back in line and then I have read on here it goes to the NVC and that process is about 2-4 weeks, then off to manila which is about 90 days til interview. I would like to be there for the interview but its very hard to pinpoint when that will be until she gets the call, so realistically how much longer would you guess that she would be here if all goes well? I was thinking like September?

Without the actual RFE - hard to say.

Did you get the first NOA at least?

Did you file within two years of your last meeting with the benificiary?

Did you make a copy of everything you sent in? Was everything signed (as appropriate)?

Can't say on how long this will delay you - they can take up to 60 days to go over your RFE evidence.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes back on december 7th, and I was there last August, and I have a copy of everything. Well 60days is better than 5months. I was hoping that it happened before winter because she has never saw snow and is a christmas nut so it would be cool for her to see the first snowfall, and she is going to have to get used to cold wisconsin winters!

Hi Steve,

Unfortunatley it is really unpredicatable as to how long you may be delayed. As far as the RFE - until you receive it you wont know exactly what it is for. Maybe time to review everything you sent to see if there is any obvious oops.

Did you include your I129F, check and the G325a's for each of you. I know it sounds stupid to even ask but it has happened!

Just an FYI - if this was the initial petition you didn't need to send bank statements and only the BC for the USC.

Its highly likely that the lawyer made an error - happens all the time. Did you review all their work before the package was submitted.

Let us know what the letter says when you receive it and best wishes!

well the one thing I did notice after the packet was sent was that I forgot to sign my permission to marry and she signed both of them, I asked the lawyer and she said it shouldnt be a big deal, and maybe it is, I hope its something that simple, but who knows. I just sent bank statements showing that I can financially support our situation. Well I guess I need to learn patience,but that I doubt will ever happen, Ill keep ya posted.

I'm with ya there Steve - but if I learned one thing through this process it was patience. Doesn't mean I didn't pull the last of my hairs out but I had to deal with it some how :rofl:

Hopefully it is just something minor that can be fixed in a jiff and sent back.

Just an FYI - when you get to the interview stage, that is when you'll need the I-134 (affadavit of support) and bank statements, employment letter, etc..that shows you can support the beneficiary.

Look forward to an update and hope all goes well.

I hope you go to the lawyer and request a refund due to the RFE.

Well I can't really blame her, because I had all the stuff prior to coming in there, I just don't have the time to mess with it right now so that is why I hired a lawyer and I wanted it to be filed correctly, but I guess I will have to wait and see wht the letter says and go from there, I am actually glad that I finally heard something.

I'm no expert and this is purely a shot in the dark, but having read through the 'entire' RFE thread, my unscientific impression is that documents related to prior marriages / divorces seem to be the most common source of RFEs. Were either you or your fiancee previously married?

We got a lawyer to check through our forms and related documents last time and we received a RFE because we didn't include the passport stamp for proof of meeting in 2 years. We asked the lawyer before n he said it was optional, not compulsary so we didn't attach that. The RFE delayed our application, i think around 2 months. It was really terrible and later I read about how many of the other members who got lawyer's help seemed to have alot of problems; their applications were delayed as well. So, seriously, I think Visajourney is the best lawyer you can ever get, monitor the process yourself.

If you wanna get a lawyer, make sure you get a really 'good' one.

Exactly. That is why you hired one. She just delayed you because she didn't do HER job and make sure every t was crossed and i dotted before she mailed in your packet. She owes you a refund.

Ya your probably right, but I think I will wait til her job is done, because part of the $500 fee is that she files all the paperwork for her once she is here, then maybe I'll chew some ####, but then again its only $500 compared to me filing it all wrong and delaying her more to come here.

For $500 you're getting some administrative assistant to prepare your paperwork, and not much else. A decent lawyer starts at around $150 per hour. What you got is the legal industry equivalent of a fast-food drive-through immigration document prep service.

I completely understand not having much free time to work on this stuff. I also considered hiring an attorney to save me from having to spend a lot of time on this. However, having had some prior experience in legal matters that required the assistance of an attorney, I know there is a huge difference between the quality of service you get when you hire an attorney for personal service and pay them by the hour versus paying one low fixed price for the service. With a paper mill legal service, the potential for losing your legal battle is dramatically increased. There's also a chance they'll leave a mess for your next attorney (whom you'll probably have to pay by the hour). If the paper mill service fails, then you won't completely understand why because you won't have spent the time to do your own research.

In the end, I decided it was better to spend a few months researching what to do, even though I could only spare an hour or two each day, and then do it myself. I consulted with a lawyer to double check my work.

To look at this from a different perspective, the time you saved by hiring the attorney for document prep may have been lost because you got an RFE. If you ultimately end up getting denied because there are other mistakes in your documents, then that $500 isn't going to look like such a good deal anymore.
