I-864 along with I-864a question

Hello- Question I have is in regards to filing my Affdvt of Supprt for my wife.

The reason for the question is because like most I worry that her visa might get denied based on the financial aspect of things. When looking at the I-864p(Poverty Guidelines based off of 2009) Im looking at the dollar signs and thinking wow. My income from my job is at 23.5k a year and I recieve 3k a year for child support I would be adding in as part of my income to become eligible. So overall 26.5k a year. My household size is currently Me,my 7yr old daughter, 5 yr old daughter, my wife, and soon to be son in June. So 1+1+1+1+1=5. So according to the 2009 Poverty guidelines that requires income of 25,790 x 125% = 32,237.5. So I am $5,737.5 short.

I currently reside with my parents, since Jan 2010. My step father has agreed to co-sponsor with me with the I-864a. His individual income is 32,948.55(Based of agi of 2009 taxes.) Now his household consist of himself, my mother, and my younger brother(under 21) So household of 3. My understanding is that he would have to meet the poverty guidelines for his own household..?

Overall our income combined is at $59,428.55. Would this be enough to financially support my wife's visa?

Does anyone have experience with this... NVC as "HELPFUL" as they are, they don't try and help out. its more less an answer like. "those are just guidelines, its upto the embassy in the country it pertains to, to decide" THAT statement is pretty broad.. its like saying hey mr./mrs. you make only 110% above the poverty guidelines, BUT since its a sunny day.. you pass..... any info would help on my previous post would help soothe some nerves..

I think no one has answered because no one who had read it has an idea of the right answer.

From what you said I think it sounds fine. DEFINITELY get a co sponsor as I bet regardless of the fact that they are only "guidelines" that you'd get denied on your own. But with your step fathers help it seems like you should be fine.

As for the size of your household, I'm not sure. And also, will the new baby be born before or after the interview? And if after the interview will the baby need to be included in the household size? Maybe not, but probably a good idea to have the extra money just in case as the consul will definitely be able to see your wife will be having a baby very very soon!

you'll be fine, but your stepfather has to cover 4, his own household (3) + your wife, that's why he's being your co-sponsor for your wife, right?

so for 4 it's $27,562, he's good.

great info, and i completely understand that some may not know the right answer.. So, question to this, is if my step father is adding my wife to his household size, does that mean i dont include her on my own..... So COMPLICATED

She WILL have to be included on yours.

Is he filling an I864 or I864A? There's no household size on the I864A. It's simply whoever's income/asset you're using.

Actually, the step father has to file an I-864. the I864a would be for the step-father's spouse, if they have income as well. Each person sponsoring has to fill out their own I-864, and the USC spouse has to fill one out, regardless of whether they have income or not.

i-864a for the step father's spouse? my mom? your kidding with me right.. i-864a indicates its a co-sponsorship for sponsoring my wife's visa that requires me and the co-sponsor to live under the same household. to use their income as a basis of qualifying for the Visa. my spouse hasnt worked in a few years.

Yeah, I think that maybe txladykat didn't understand that your step father LIVES IN THE SAME HOUSEHOLD as you.

For example, joint sponsors need to fill out an I-864 as well. However, if they are CURRENTLY living in the same household as you then they fill out the I-864a. Your mom DOES NOT keep to fill out the I-864a as well, as long as your step-father makes the required amount of money on his own. But here's the confusion:

You're filing DCF right? That means you don't live in the US, so how do you live in the same house as your father??

Oops...just looked at your profile, you aren't filing DCF! Just a hint in the right direction, you'd get a lot more replies quicker under the IR-1/CR-1 board as there are more of them and they tend to respond faster then us DCF-ers, just in general!

As far as you BOTH including your wife on the forms, I don't know the answer to that. It seems like you shouldn't include her twice as the forms specifically say not to include any 1 person more than once....

Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.

For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence. And their proof of citizenship as well.

Thanks! the info is great. what im looking for is a little more complex it seems. Because the forms are in order. BUT what im trying to determine is if me and my co sponsor in our household sizes and income combined if its enough to meet that 125% above poverty guidelines and what is used to determine qualification... like this example.. if im 5 k short from making it to the 125% mark, does my co sponsors income help with that insufficient amount or is our income combined to say ok you make 58k together and you need 50k to meet the need to sponsor.

As long as both of you can combine your incomes to meet the guidelines for that household size, it should be fine.
