Hi,

Just a couple of quick questions:

(1) As I read through the archives here there is a lot of talk about 'high fraud consulates' but I've not really seen any kind of list of which embassies fit this definition. Is there some kind of objective measure or is it pretty much just a subjective criteria. In either event, I'm wondering whether or not people consider Bogota, Colombia to be a high fraud consulate?

(2) A few weeks ago I received in the mail from my fiancee, signed / dated copies of her G-325A and letter of intent. The forms are dated April 3rd, but unfortunately, I still haven't got everything together to send the I-129F packet off. Does it matter if the signatures are stale by a few weeks?

The signatures can be off by a few weeks with no issue. The only reason USCIS might think there is an issue is because the passport style photos should be taken within thirty days of the submission of the I-129F. She did send you recent passport style photos didn't she??? Anyway, if the signatures are dated six weeks before the submission, then the photos are probably not within specification either.

1. Just anecdotally, when I think of high fraud consulates Bogota doesn't ring a bell as one of the worst offenders (Anything in MENA, Ecuador, Nigeria) but also neither does it ring as one of the easy ones (Canada, UK, Australia...) There is a link at the top of the page for Reviews: Embassy/USCIS POE. You can read up about people's experiences there. Based on that research, you may consider "front loading" your petition with some of the requirements, especially for relationship bonafides with your petition packet.

2. No, I don't think they would consider the signatures to be "stale" Hell, they might not even look at your petition for 6 months, what is a week or two to that? It's perfectly understandable that it may take some time to assemble the filing.

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Heather is correct. From personal experience, hear me now: Be eternally thankful that you are NOT dealing with a certain smaller neighboring country's U.S. consulate, si man!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Not that we did K-1, but since we all go through USCIS the same, here's my 2 cents.

We signed our paperwork August 1st. We didn't submit the petition until Halloween. By the time USCIS received it, the signatures were 3 months old. No problems so far. I can't see a few weeks making any difference. Just bring an updated letter of intent to the interview, just in case.

10-30-2009 : I-130 and Documents Sent

11-06-2009 : NOA1

02-18-2010 : NOA2

NVC : 66 Days

02-24-2010 : Case Number Assigned

02-25-2010 : E-Mails Given to NVC Operator

02-26-2010 : DS-3032 Sent by E-Mail

03-02-2010 : Received DS-3032 and AOS Bill

03-02-2010 : DS-3032 Accepted

03-02-2010 : Pay AOS and IV Bill Online

03-04-2010 : AOS Shows PAID

03-08-2010 : IV Bill Shows PAID

03-09-2010 : AOS and Documents Sent

03-09-2010 : Receive IV Bill

03-19-2010 : DS-230 and Documents Sent

03-24-2010 : False RFE for DS-230; Confirmed AOS Reviewed and No Missing Information Found

Agreed - dates should not be a problem. I had Doan sign papers when I was in Vietnam in April 09 and did not send the petition until June 09 so there was a few months between - not a problem for us.
