Every scenerio is different, so its so difficult to find exactly what im looking for. So please have patients on me.

Im a US Citizen. I was married to an Ecuadorian in Ecuador where we have lived for 1 year.

My wife has her B1/B2 Tourist Visa, bbut circumstances have changed and we want to begin the process for her Green Card and possibly Citizenship.

Heres where I need help:

1) Can we begin the process together in the US. We were planning a trip in June with my wife using her Tourist Visa. Is it better or quicker to begin the process right away or wait until we are both together in the US. That being the case, the tourist visa has a max time limit in the USA of 6 months. Is it typical for someone to obtain their Legal Permanant Residence in under 6 months?

2) After the Green Card is obtained, its 3 years maintaining their residency in the US if they are married to a US Citizen. After that, they can apply to become a citizen?

You can't abuse B2 visa to have your wife come here and adjust the status, so no, she can't come anf get her green card that way. Follow the guides for CR1 visa.

Your wife can actually come to the US with her tourist visa and then adjust status to permanent residency but that would raise some eyebrows and they may even consider it as fraud. A person with a tourist visa should not use it with the intention of staying in the US permanently.

You can file for a CR1 visa right now which can take anywhere from 6-12 months and that way she can enter the US and stay legally after that.

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

If the intent is to immigrate then B2 is not the visa she should be using. Think about it, at the POE they will ask her purpose of visit, what will she say to that? Misrepresentation and lying to immigration is serious and has penalties as hard as lifetime ban. The right way is to apply for spouse visa. Maybe DCF if your are eligible and the Consulate has the option.

If you (as the US citizen) have been in Ecuador for a year, why not file DCF? It's faster and you can do it all in Ecuador together.

2008-04-28.....I-130 Approved

2008-05-02.....NVC Received

2008-08-20.....Case Complete at NVC

2008-10-14.....Interview--221g, asked to present joint sponsor inspite of NVC approval

2008-11-07.....Visa due to arrive. DHL truck delivering visa was robbed, Consulate required us to present I-864s and DS-230 again, had to get a new passport and other related documents

2008-11-14.....Presented all new documents in person at Consulate, visa printed same day

2008-11-25.....POE Atlanta

2008-12-26.....Green Card and 2nd Welcome Letter arrive

2010-09-02.....Date of NOA ROC 1-751

2010-12-13.....Approval of ROC

2011-01-12.....10 year Permanent Resident card arrived

2011-12-20.....N-400 Application mailed

2011-12-29.....NOA

2012-02-02.....Walk-in biometrics (appt was for 2/16)

2012-04-17.....Interview

2012-05-18.....Naturalization Ceremony

I suggest you file via DCF this week - it's the I-130 petition , filed at the IV Unit at the Embassy.
