 totally agree with you!!

It's important to bear in mind that USCIS has no clue what NVC is doing and USCIS or DOS visa info line operators don't either. Don't bother calling USCIS misinformation about much of anything but certainly not about NVC policy.

That's not the worst case. It's the definite case. Filing the I-129F causes the I-130 to lose its place in line and get back in line where the I-129F sits, so filing it has been delaying I-130 approvals for the last three years.

If there's not going to be any K3 visa issued, there's no point in delaying your I-130 and CR1 process.

That USCIS and NVC are different agencies is not "news". It's the "problem". Take it from somebody who actually did bring their spouse on a K3 visa in 2006 and has carefully watched the evolution of K3 from viable and time saving to it's death, February 1, 2010. May it be resurrected for the small percentage of cases where it has value, is my wish but it's a wish, not a realistic expectation.

HI, one Question i filed two applications i have NOA1 Date Dec 9 2009 for I-130 and NOA1 Date Dec 16 09 for 129F, my Timeline Says Based on timeline data, your I130 may be adjudicated between February 21, 2010 and March 20, 2010, but now is 3/24/2010 i dont have any case update, i check in the USCIS Website my case I-130 has been touched 3/23/2010 what this mean, thank you for you help.

If you got a touch, it means that they are looking at your file... For many, this preceeds getting an approval... Good luck...

Bull$hit in what USCIS operator that had to put you on hold to even find out what the hell you were talking about!!!! You can believe that person OR go with what the people here on VJ have to say and have experienced!!! Your choice! FILING THE 129 WILL SLOW YOUR I-130 DOWN!!! They pull the application out of line and put it with the newly filed I-129... Then they are approved together and the I-129 is closed and you wasted time for them to process 2 applications (knowing that only the I-130) would be used...

Its' your time to wase however so choose as you will... believe who you want... But generally the people here on VJ have a better grasp of how things ACTUALLY work, versus an operator with a script who has never went through the process

Well seeing how you really feel strong about your opinion and it seems to be consistent with others, I'll wait to see what happens with the I-130 and will not move forward with the I-129. Whewwwwwwww what a process.

  • 2 weeks later...

thanks very mucu for your replies. it's actually my mom-in-law who sends out the paperwork because my husband, kid and i are all here in the philippines. we initially asked her to send the I129-f but she decided not to because she thought there was a $455 fee (which was for fiancee visas only) and because she called the this hotline and the rep told her that they stopped issuing k3 visa and should just pursue the the immigrant visa.

okay.

we called her yesterday to greet them a Happy Easter, and she told my hubby that she already sent the I129f. So there...I guess we'll really find out how the NEW process is. We'll have 2 scenarios, mine, with which I129f was sent and rvince's who didnt.

Goodluck!
