Waitingincolo - your situation is definitely unique. What I don't understand is why they were not able to expedite your petition based on USCIS error - has your senator been able to help you with this?

I have 2 U.S congressan's offices involved with my case and they both seem disinterested in my

case. I have called them many times and ask them if they could get my case expedited, Both offices

tell me that the ask that my case be expedited, and then they tell me to wait (haven't we all heard that

before) I'm not sure, but I think when you ask the uscis to expedite a case it needs to be in writting.

I really believe that most of us going through this process know more about whats going with the uscis,

then the peaple that are avaliable for us to contact.

Its sad that we have to go through all this just to get a loved on here.

waitingincolon,

I hope you resolve your situation soon. I know it must really blow to watch people who mailed their petitions off way after you receive their NOA2's. I know it doesn't mean much, but good luck.

I have seen a few others with NOA1's before yours though. I think there were other circumstances involved though.

My suggestions, for what they are worth:

1) You are not getting the help you need from your congressman's offices. Why not contact your senator's office? You need to locate their website, download the privacy form, fill it out with all of the relevant information including your case number, and fax it to their office. Then call to follow up and get the name, direct phone number and email address of the case worker.

2) You don't need your congressman or senator to write a letter to request that they expedite your case. All the information is available directly on the service center websites. I'm not sure if you are now back at NSC or CSC but here are the links:

http://www.uscis.gov/graphics/fieldoffices...s.htm#Expedited

http://www.uscis.gov/graphics/fieldoffices...nia/aboutus.htm

If I were in your shoes, I would write the letter, send it fed ex and email to follow up

California:

General Expedite Procedures:

A detailed explanation of the situation should be provided in a one-page support letter prepared and signed by the petitioner or the applicant. An expedite request can be submitted by mail or fax. When mailing, mark the envelope with a red dot and send the request via bonded courier or other overnight delivery service to:

USCIS

California Service Center

24000 Avila Road, 2nd Floor, Room 2312

Laguna Niguel, CA 92677

Nebraska:

Requests for expedited handling for all other applications and petitions will be considered subject to the following seven criteria:

Severe financial loss to company or individual.

Extreme emergent situation.

Humanitarian situation.

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States.

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our government.)

USCIS error.

Compelling interest of the USCIS.

To request expedited processing, provide the reason(s) why you feel the case should be expedited. Be sure the request is supported by adequate, relevant documentation. State "EXPEDITED HANDLING REQUEST" in the heading of the letter and on the envelope.

Cannot offer any suggestions, but I am sorry to hear of this. Really sucks in a big way. A reality check for sure.

Believe iceyspots is also in the same boat as you.

Best of luck to you all.
