I recently just filed the AOS and EAD concurrently like most K-1 holders do. Both the AOS and EAD requires a copy of the spouse's passport, visa and I-94. I did include all of these copies when I sent it to the USCIS. However, I didn't include 2 of each. Is there a need to have 2 of each, one for the AOS and one for the EAD? I hope that's not the case, 'cause then I'll just get another RFE!

It is possible considering the I-485 could end up being transferred to CSC and the I-765 remaining at NBC

--AOS--

- Copy of K1 visa in passport

- Copy of I-94 – Arrival/Departure record (front & back)

The two items listed below are on the VJ AOS Guide, however NOWHERE on the forms, or their instructions is it mentioned that these items are required. These items only serve as additional information. You are required to bring your passport to the interview (if you have an interview) so perhaps by mailing this information you might not need to have one. Ultimately more info is better than less info (within reason of course) so it can't hurt. Personally I'll be including them in my parcel (in my attempt to avoid an interview tongue.gif) but it makes sense that they're not needed as your Alien number is your identifier now (where with the K1 your passport number and then case number were).

- Photocopy of passport biographical details page

- Photocopy of USA entry stamp dated #####

--EAD--

- Photocopy of passport biographical details page

As we're applying together with the AOS then the following isn't REQUIRED, however if you choose to include it, it's up to you, like i said before, more info is better than less info

- Copy of I-94 – Arrival/Departure record (front & back)

As you can see from the list, The AOS doesn't require the passport details page but the EAD does. The EAD doesn't require the copy I-94 but the AOS does so REALLY you should be fine.

I remember that my scan of the I-94 and the visa is on one page as well, so there's no seperate scan for the I-94 and the visa. It was kind of difficult to scan one or the other since they are attached so I had the passport flat and scanned both at once.

Please no RFE's!

I-94 is only held into your passport with a staple... simply remove the staple, photocopy accordingly and then re-staple... not that complicated
