We submitted the K-1 visa application to the California center and they acknowledged receipt of it on Oct 8th 2009,

We are still waiting for any word on it. I have flown back to USA just so I would be here when we got it but it still has not come.

Also what happens if and when I do get something from them, what do we do with it. We have all doc's that we should need but just need physical and interview. We are ready but nothing is coming out from them.

Any info or help would be great.

Rick

Have you called them or considered contacting your Congressman? Since you're outside of the usual processing times, I'd start making inquiries.

you mean you got the NOA1 for the 129f already? that's a good. now it's in the process of being evaluated and while the average no. of months it takes is 4-6, it could be shorter or longer, depending on such factors as completeness/correctness/accuracy/organization of application, the person evaluating your application, bulk of applications for your batch/month etc.

at least you haven't gotten any notice for additional docs (RFEs)...just wait with lots of patience and before you know it you'll get your NOA2 (approval notice)

good luck and god bless! :)

I understand your frustration. My k1 took 6.5 months to be approved, with no touches for 6 straight months. At the time, it was taking most people 4 months to get approved & standard processing time was listed as 6 months.

I engaged my senators/congressman, but am not sure that helped. I also had an Infopass appointment while waiting, but I don't know if that helped either. Based on the fact that there were several us of who filed and were not approved in the 4-4.5 months of the rest of our month's filers, and all of us got approved within about a week (2 months after the rest of the filers), I think they lost the box with our files for a while. :: shrug :: It happens.

On the bright side, it eventually got approved & my then fiance came over. Now we've been married a couple of months & those extra 2 months of waiting isn't that big of a deal. It did add to the costs, as I made a couple of trips to visit him that I didn't expect to make, while waiting.

I hope the fact that you aren't the only one to wait extra time offers you some comfort.

I will try that after a couple more weeks as I understand that the processing time is now 5 months, and it has just now been 5 months.

Thanks Ric

Yes this is correct. The processing time as listed by the USCIS is currentlly 5 moths for the I-129F petition whether it is being adjudicated at VSC or CSC.

Do you have youe WAC number or EAC number> Then you could go to the USCIS website at www.uscis.gov, and sign up for an account. Then you could check to see what stage it is at. It might be possible you are approved or they sent you an RFE and you have been overseas unaware of what the status is.

Good luck.

I do have my WAC number and we are just now waiting. I have gone to the web site and registered for email delivery of notices etc. So I am there, but it only show my application as in processing. So we wait. Is there anyway of calling them to see what up? Emailing them??

Thanks Rick

I would say, be patient but I know how much it sucks sometimes trying to just sit and wait. Call up USCIS when it's more than 6 months - remember 5 months waiting period is only a median!! - and ask for a request for an update on your case (may take between 3 and 45 days until you hear from them). They can be pretty helpful AFTER the 6 months! All the best

You have some good answers already but as you go through this process, it's critical to understand what is what. You did not submit a K-1 visa application. You submitted an I-129F petition for fiancee. After that petition is approved, your fiancee will be invited to apply for a K1 visa at a Consulate abroad.

I would begin the inquiry with the Senior US Senator from your State now, so that they can make the inquiry for you as soon as they are able. Most cases now are taking just over three months for petition approval, regardless of the CYA five month standard you see posted.
