My wonderful much beloved in the US sent our forms off on the 13th of last month and we are still waiting for the NOA1. We are both starting to get a bit worried about this, not only cause it will keep us apart longer but her birth certificate is in there so that would be a real hassle having to get one again and take even longer. Please someone tell me that this may be an unusually long time to wait but it doesn't mean there is a drama. We've been apart to long as it is. :help:

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Questions

Did he send it signature required?

Has the check been cashed?

If the answer to both or either is yes, then you will eventually get your NOA1

If the answer to both is no, then you probably have a problem and should be calling the customer service number to see if they can find your petition. It has been taking up to a month to get your NOA1, but you are overdue now.

June 05 Lisa and I fall in love

15 Mar 06 I-129F received at CSC NOA1

5 Aug 06 NOA2 after 143 days in CSC purgatory

20 Oct 06 Interview Date

16 Feb 07 Denial Letter received

12 Mar 07 Motion to reconsider submitted

10 Sep 07 Motion to Reconsider denied

9 May 08 Lisa and Married in United Kingdom

23 May 08 I-130 filed

Oct 08 NOA-2 received

That does seem a bit longish, but Nebraska isn't the fastest service center and also IMBRA could have slowed things down a bit. Did she send a check and has it been cashed? If you're really concerned and since its been more than 30 days, I'd be inclined to call and check on it.

She didn't send a copy of her birth certificate? Originals are not required with the petition. At any rate, she can likely order another one on the internet. Shouldn't take that long.

Here's something my lawyer actually did that helped me: he told me if my check was cashed they would print my case number on the back of the cashed check. Luckily, my bank posts my cashed checks online so I could access the case number. Then I went online to register for online updates on the USCIS website. Soon after it was cashed, I got my NOA1.

And with that said, you can read about how to check for updates here: http://www.visajourney.com/forums/index.ph...c=22852&hl=

I've got a question: when do they transfer K1s filed with Nebraska and Texas to CSC or VSC? After NOA1 or before that? Maybe another VJ who got their case transferred could help with this.

I only offer advice - not even legal. Just the plain and simple kind.

Right, thanks! In this case, the check is cashed before or after the transfer?

After, if I am not mistaken.

If so, they'll transfer the petition and then cash the check. This could explain why NOA1 is taking long for the OP. Besides the speed at which they work on petitions at different service centers.

Thank you for everyones help and support.

Still no news.

Unfortunately she sent the payment by money order so we can't check on wether thats been cashed or not.

I should just hope that it's doing a tour of every service centre in the country and hasn't been lost at the back of some postal sorting office somewhere.

Thank you again everyone

We had a problem with the money order my fiance sent. He contacted the company that had issued it and was able to find out whether it had been cashed or not...
