Wife wants a divorce

Ok my wife and I took the long journey ( 2 years ) getting the K3 visa for her to come here. We have a beautiful baby daughter together. Everything was great. No problems. Now a soon as she got to the states ( less than 2 months ) she now wants a divorce. I dont get it. She wont explain herself. So now what? I mean the whole process. What happens with her visa? Does she have to return to Peru? We have a child! Please if anyone knows what would happen to my wife if we get divorced can you please tell me

She can't stay - K3 is null and void when divorce occurs and given no adjustment of status happened she has to go. If you got your child a US passport you can have the child stay with you or if you agree for her to take the child back to Peru you need to give your consent in paper form.

Are you sure she's not just suffering from culture shock or missing her family back home?

She can't stay - K3 is null and void when divorce occurs and given no adjustment of status happened she has to go. If you got your child a US passport you can have the child stay with you or if you agree for her to take the child back to Peru you need to give your consent in paper form.

Are you sure she's not just suffering from culture shock or missing her family back home?

How do we know that an AOS hasn't occurred?

Where does she want to stay, in the US or go home?

Life in a foreign country takes adjusting to and is especially hard with a very young child. Does she speak much English, have much independence or anything to keep her entertained when you're at work? How old is your baby and is it possible that she's actually suffering from PND (Post Natal Depression)?

I'd say don't panic, she sounds like she has an awful lot on her plate right now and needs calm, loving reassurance and support more than anything. With a bit more information, we can probably come up with some ideas that you could help her with and could make her feel a little happier with you in the States.

My husband is from Peru and I can tell you that the first couple of months are very difficult for them to adjust. My husband was from Lima and was used to many modern things and is very good with a computer. However, there are huge differences between our culture and theirs and as a result alot of fights occur. The first few months my husband was unhappy in the United States. He missed his family, hated our food, and was completely bored. It really takes alot of patience and hard work to get over the culture shock and misunderstandings of the first month. My husband now has his own job, car, friends, and soon will be starting college. He is much happier now and we rarely have arguments. Try to be very understanding with her and remind why you both scarificed every day for 2 years to get her here.

Sounds like she may have worked you for a GC.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Parental rights are 'awarded' at time of divorce. IMO, the best place to 'learn your rights' is at the Law Library attached (or affiliated with) the Court that will handle your divorce. Find that library, befriend the law librarian. Many divorce courts follow state guidelines and laws, also.

If you are worried she will keep the child away from you 100 percent - you might want to engage a bulldog attorney and go for YOU having 100 percent 'rights to the child' with weekly supervised visitations from the mother.

Usually, the person that files the divorce 'drives' the divorce paperwork - so if you want a bit of control - YOU file , not her.

My main concern is the child right now. She is a US citizen, but what if the mother wants to take her back to Peru with her? What are my rights?

peru and USA have a child protection agreement that makes "parental kidnapping" illegal. if the child is being raised in the USA then the courts will view any removal of the child from USA in a very dim light. you should see a divorce attourney and file for a joint custody document that specifically addresses this fear. once a judge's signature is on it, it can be enforced in most countries.
