So i need a joint sponsor with my fiance because I don't make quite enough money to support 3 people under my income. Anyway, my parents don't want to sign the affidavit if they would be responsible for medical bills for him in the case of an accident or the like. Does anyone know about that? Would they be responsible for that because they could be thousands of dollars... help! I really hope the answer is no because otherwise he really wouldn't be able to come. that would just be tragic...

10/5/09 - NOA1 sent

11/16/09 - request to expedite petition for humanitarian and medical reasons (I am pregnant with our baby due 1/22/10)

11/17/09 - request DENIED

1/7/10 - NOA 2 sent

1/13/10 - National Visa Center receives petition

1/22/10 - our baby is born right on his due date!

2/4/10 - make appointment with US embassy in Guayaquil

2/18/10 - I arrive in Ecuador with our little one, we meet up as a family

2/24/10 - Visa appointment with Embassy...Visa Approved!

3/10/10 - I fly back to the states

3/17/10 - He flies to the states

5/19/10 - We get married

10/10? - File for Green Card

1/6/11 - Green Card Interview - Accepted

You dont have to have your parents sign the affidavit of support, your grandparents, or best friend, anybody who knows and supports you and your situation with your SO could do it. Also, if your husband is in landscaping or another dangerous job, you can go to a place like med center 100, or another place that gives good medical care without insurance for lower prices. i do not know where you live, so the discounted places may vary in your state. Also, if your husband is involved in an accident, through his job, his job should pay for it, that is why the have insurance for their employees, if they do not have insurance there for their employees, then you might want to reconsider him working there. if he cannot go under your health insurance, for whatever reason, he could work at a restaurant or something like that, they do offer benefits that he can get to cover himself until you and he are stable enuf to go under the same health insurance. As far as other 'accidents' there shouldnt really be any, except for freak accidents, and i would imagine that him being your SO, that your parents should be willing to help him because you care so much about him. The affidavit of support is more for welfare and that kinda stuff, so that the government and taxes do not go to a foreign born national, that is what the affidavit of support is for, to take care of the foreign born national so that they do not become a public charge. I hate to be the bearer of bad news but they well COULD be.

Basically the affidavit of support is your parents stating that they will support the people on the forms as much as needed. It's a document to protect the government in the event he becomes a public charge. It's likely that you as the "primary" sponsor will be chased first, but they CAN chase your parents as well.

Page 3 of the I-864 instructions state: "Even if one or more I-864s are submitted for an intending immigrant, the petitioning sponsor remains legally accountable for the financial support of the sponsored alien along with the joint sponsor(s)"

Also, on page 17 "Under this contract, you agree that, in deciding whether the intending immigrant can establish that he or she is not inadmissible to the United States as an alien likely to become a public charge, the U.S. Government can consider your income and assets to be available for the support of the intending immigrant."

"If an intending immigrant becomes a permanent resident in the United States based on a Form I-864 that you have signed,then, until your obligations under the Form I-864 terminate, you must:

--

Provide the intending immigrant any support necessary to maintain him or her at an income that is at least 125 percent of the Federal Poverty Guidelines for his or her household size (100 percent if you are the petitioning sponsor and areon active duty in the U.S. Armed Forces and the person is your husband, wife, unmarried child under 21 years old.)"

thanks for the replies. I've done more research and it looks like ones obligations under the affidavit of support are much more extensive than what the form leads us to believe. Say we get divorced, he could sue me and/or my parents for the amount of money that would put him at 125% the poverty line for a family size of ONE (strange considering that that accounts for MORE money than one would have to prove to be able to provide on the affidavit of support). And say your spouse decides never to work or get naturalized, the obligation towards this person lasts for forever...

Anyhow, I'm not planning on getting divorced so I'm just going to have to be positive and hope for the best. This thing has to be signed in order for him to be over here. I also talked to my parents and it looks like as long as I promise to get him on at least catastrophic insurance (which I looked up would be like $80 a month) then they'd still sign it. ok, so here we go...
