I would like to be the sole sponsor of my Mexican husband without involving any other relatives. We live in Mexico and will stay here until he gets his visa. Right now I am a stay-at-home mom (so unemployed) and I don't plan to look for a teaching job in US until my husband gets his visa. I worked in Mexico before I had the baby but I never filed taxes in US because my income was too low. I plan to use ONLY assets to show my sponsorship.

Questions:

1. First of all, is that possible to do....ONLY ASSETS?

2. When they ask for annual income in question 23, I put 0, CORRECT? Also, in Question 24 a and 24 c, I put 0, CORRECT?

3. Then, in Part 7 where it asks for assets, that's where I put all my assets as long as I make sure my total is 3 times the 125 % poverty guideline (i'm sponsoring my hubby and we have one minor child), CORRECT?

Yes, but you would need a lot to cover it.

2. When they ask for annual income in question 23, I put 0, CORRECT? Also, in Question 24 a and 24 c, I put 0, CORRECT?

If you have zero income, than that is what you put in.

3. Then, in Part 7 where it asks for assets, that's where I put all my assets as long as I make sure my total is 3 times the 125 % poverty guideline (i'm sponsoring my hubby and we have one minor child), CORRECT?

Yes. Assets can be savings, stocks, bonds and property. They must be easily converted to cash.

Unless you have a lot of assets (I would even go as far as saying 5x the amount needed), you might be wise to line up a co-sponsor, just in case.

Also - you have to meet the domicile rule for the 864, and if your living in Mexico - how will you show that?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Of the possible evidence that they show to prove domicilie, I can do both a lease to rent and also maintained bank accounts. Do you think that's enough?

You can do it on assets only- we did. It is best if the assets are US based, rather than in a foreign country.

Your domicile evidence is good. Do you have a US driving license and/ or voter record? That would be good too.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I don't have a voter record because for the past 2 elections, I haven't voted since I was overseas and never filed for Overseas Voting. Anything else I can use besides lease, bank accounts, driver's license?

Oh also, so if you did assets only, did you put ZERO for annual income in questions 23 and 24 on I-864?

Yes, my husband put 0.

Other things for domicile could be: proof you have been looking for a job, if you have kids, school enrollment, or if you have chosen a church place of worship already, letter from the pastor.

Domicile or trying to prove reestablishing domicile are 2 completely different things - they require different approaches.

This question is very consulate specific and I would encourage you to speak to others who have interviewed at the same consulate as you are.

If you submitted that evidence in Montreal - they would never approve your I-864.
