Renewing my driver's license

Timeline

Hi all. My green card and driver's license both expire on the same day (On Jan. 28th). Do you know if I can renew my driver's license with the receipt they sent me extending my green card for a year??? thanks for any replies.

02/13/2007:NOA2 received

03/15/2007:Checklist received from US embassy

05/17/2007: Interview at US Embassy

05/22/2007: Visa Approved!!!!!!

05/28/07: Entry into the US... together again!!!!!!!

06/04/2007: GOT MARRIED!

08/13/2007: AOS sent

09/18/2007: NOA1 received for AOS and EAD

09/25/2007: Applied for AP

10/09/2007: Biometrics Appointement

10/25/2007: Advance Parole documents received! approved!

11/23/2007: EAD received in mail (woohoo)

12/15/2007: Case transferred to CSC

12/24/2007: Case transferred again for "standard processing"

01/30/2008: Card production ordered. yay!!!

Removal of Conditions Timeline

12/31/09 I-751 packet sent

01/04/10 NOA Received - GC extended

01/29/10 Biometrics Appoint.

I dont see a reason why not as the NOA 1 is a 1 year extention for your GC

DMV or SOS should accept the NOA as a proof of legal residence. However, I would get familiar with their manual which should be found online and see the accepted forms and documents for proof of residence or legal presence in the US then go to the DMV. It will allow you to talk to them intelligibly and sometimes they are not very familiar with their laws, and could give you the wrong answer. Therefore, you can print that page out and show them if they get too stubborn that their manual says you can renew.

My state is the same way and they require 6 months of proving I am a lawful resident, but I checked their manual and it states that a NOA is sufficient. I printed that page before going there and everything went smoothly!

I hope I am clear, if not, let me know and I can clarify.

Oh, I just checked your MT Driver License Manual and they say that I-551 stamp will be official, but nothing about the NOA.

Technically, a GC with NOA extension means it is not expired. You can try and see what that means. Maybe you should find an explanation from the USCIS website how the NOA works and the effect of it and print that as well and take it with you to the DMV/SOS.

I will have the same problem in a few months.. but I was told that CA DMV accepts the NOA1 as proof of extension :)

Every state is different though.. so let us know how it goes!

You should, but unfortunately the DMV employs many people with very small brain capacity, similar to those of monkeys. They function pretty much like drones, so when they encounter a document they haven't seen before, they shake their heads.

What that means to you is that you have to know what might happen once you hand over the expired GC and the NOA1. Be prepared for a DMV employee to look at you like a fish trying to look through a bubble, and telling you what you have is not sufficient. You need to be prepared and have your response ready; ask to speak to the head of the Department as those guys usually are a notch smarter and understand sentences like "extended one year."
